Correction of wage determinations containing clerical errors
Clerical errors in wage determinations must be corrected immediately, and contracting officers must follow prescribed procedures to implement these corrections in solicitations and contracts.
Overview
FAR 22.404-7 addresses the correction of wage determinations that contain clerical errors under the Construction Wage Rate Requirements statute. If a wage determination is found to have a clerical error, the Department of Labor’s Wage and Hour Division Administrator can correct it either on their own initiative or at the request of the contracting agency. These corrections are effective immediately and apply to any ongoing solicitation or active contract. Contracting officers must follow specific procedures for implementing these corrections, depending on whether the correction occurs before or after contract award, and whether it involves exercising an option to extend the contract. The referenced procedures are detailed in FAR 22.404-5 and 22.404-6.
