Forms
FAR 13.307 mandates the use of specific federal or agency-approved forms for simplified acquisitions, ensuring consistency and compliance in procurement documentation.
Overview
FAR 13.307 outlines the required and permissible forms for use in simplified acquisitions, distinguishing between commercial and non-commercial products and services. It specifies which standard forms (SF) and optional forms (OF) should be used for various procurement actions, including solicitations, orders, modifications, and invoicing. The section also allows for agency-specific forms or automated formats, provided they conform to the standard forms as much as possible. Special provisions are made for purchases using imprest funds or third-party drafts, and for situations requiring additional space or modifications to purchase orders.
Key Rules
- Commercial Products and Services
- Use SF 1449 for solicitations, contracts, and orders (see FAR 12.204).
- Other Than Commercial Products and Services
- Use SF 1449, SF 18, or agency forms unless quotations are solicited electronically or orally. Agency forms should closely follow SF 18 or SF 1449 formats.
- SF 1449 and OF 347 are multipurpose and may be used for various procurement documents.
- Forms for Both Commercial and Non-Commercial
- OF 336 and OF 348 (or agency equivalents) may be used for additional space or to include clauses.
- SF 30 or a purchase order form may be used for modifications, unless agency regulations specify otherwise.
- Special Forms
- SF 44 is a pocket-size multipurpose form for field use (see FAR 13.306).
- SF 1165 or agency forms may be used for imprest fund or third-party draft purchases.
Responsibilities
- Contracting Officers: Must select and use the appropriate forms for each acquisition type and ensure agency forms conform to federal standards.
- Contractors: Should be familiar with the forms used and ensure proper completion and submission as required.
- Agencies: May develop their own forms/automated formats but must ensure conformity with federal forms and compliance with agency regulations.
Practical Implications
This section ensures consistency and compliance in documentation for simplified acquisitions, reducing errors and streamlining procurement. Contractors and agencies must be vigilant in selecting the correct forms, especially when using agency-specific or automated formats. Common pitfalls include using outdated or incorrect forms, or failing to include required clauses or information.
