The contract extension for hazardous waste removal services in Tucson, Arizona, continues the work initially awarded under contract SP4500-16-D-0008 effective January 29, 2017, with Heritage Environmental Services, LLC as the prime contractor since October 2020. This contract involves the removal, transportation, and disposal of various types of hazardous and non-hazardous wastes, including RCRA hazardous wastes, PCBs, universal wastes, and compressed gas cylinders within a 50-mile radius of military installations or designated pickup points. The services encompass all necessary personnel, equipment, packaging, labeling, transportation, and compliance with environmental laws and regulations. Due to recent changes in pricing and the Performance Work Statement, the solicitation review has been delayed, necessitating a one-month extension of the contract through February 28, 2022, to avoid interruption of these critical environmental services. The extension is justified under the authority of 10 U.S.C. 2304(c)(2) for unusual and compelling urgency, as any break in service would risk mission failure, environmental compliance violations, and increased cleanup costs due to hazardous waste storage limits and spill response requirements. Heritage Environmental Services is identified as the sole responsible source capable of meeting the urgent government need during this interim period, and transitioning to a new contractor would result in duplication of costs and timeline disruptions. The extension will be executed at the option period rates previously established and deemed fair and reasonable. Efforts to promote competition are ongoing through a competitive solicitation in progress, but market research confirms that no alternate sources can fulfill the requirements within the necessary timeframe. This carefully managed extension aims to maintain uninterrupted hazardous waste management services critical to the Department of Defense’s operational and environmental compliance objectives in the Tucson area.

Justification and Approval for other than Full and Open Competition Extension of Services, Tucson 1. Contracting Activity: DLA Disposition Services, J-76 2. Description of Action: Contract SP4500-16-D-0008 was awarded with an effective date of 29-Jan-17 to Envirokleen; Heritage Environmental Services, LLC became the prime contractor on this contract via a novation implemented on October 1, 2020. This contract consists of one (1) 30-month Base Period, followed by one (1) 30-month Option Period. Due to the recent changes to the price schedule and the Performance Work Statement, the solicitation review has been delayed, the contract will be extended one month, resulting in an expiration date of 28 February 2022. 3. Description of Supplies/Services: Work will consist of the removal, transportation and disposal of RCRA hazardous wastes, non-RCRA wastes, State-Regulated wastes, Non-State Regulated wastes, Universal Wastes, Compressed Gas Cylinders, and Polychlorinated Biphenyls (PCBs) located on or around military installations or within a 50-mile radius of any pickup point listed on this contract in the state of Arizona. The contractor agrees to provide all services necessary for the final treatment/disposal and removal of the hazardous and/or non-regulated property listed in the Schedule of Services in accordance with the respective national and state environmental laws and regulations. These services shall include all necessary personnel, including applicable subcontractors, labor, transportation, packaging, equipment, and the compilation and submission of all documentation required by this contract to include inspecting, packaging, marking and labeling, loading, unloading, removal, transportation, and disposal/recycling of hazardous/special wastes. 4. Authority Cited: 10 U.S.C. 2304(c)(2), Unusual and Compelling Urgency as authorized by FAR 6.302-2. 5. Reason for Authority Cited: 10 U.S.C. 2304(c)(2), as implemented by FAR parts 5.202(a)(11) and 6.302-2, Unusual and Compelling Urgency is cited. Not extending the services would cause unacceptable delays in fulfilling the Governments requirement for these services. See 10 U.S.C. 2304(c)(2) or 41 U.S.C. 3304(a)(2). The proposed contract modification will be issued pursuant to the authority of FAR 52.217-8, Option to Extend Services, which is included in the current contract. The Government has a need to extend the contract by one (1) month to allow sufficient time to finalize the solicitation and review process. The Tucson HW contract requires uninterrupted hazardous waste disposal/management services to meet their mission, and to remain environmentally compliant and protected. If the Government were to solicit, analyze, and award a new contract that may only be good for one (1) month, this action would require a longer period of time to provide the services required and would result in a break in service for the customer. A break in service would result in serious financial injury to the Government. Any disruption to the services currently being performed under contract SP4500-16-D-0008 would lead to a disruption or mission failure. Without contract coverage the area is at a high risk of compliance issues regarding the regulatory storage time limits, as they already have a significant amount of hazardous waste requiring removal. These are critical services, as no hazardous waste products may exceed ninety (90) calendar days total storage time period for shipment to an off-site disposal facility. In addition to storage issues the area would be at risk of not being able to immediately respond to spills, which could lead to environmental issues, fines, and higher cleanup/remediation costs. 6. Efforts to Obtain Competition: It is not practical, nor in the Governments best interest, to award a new contract considering the need for waste removal located on or around military installations or within a 50-mile radius of any pickup point listed on this contract in the state of Arizona. The process does not allow sufficient time to acquire services for the interim period. Heritage Environmental Services, LLC (Heritage) is the only responsible source that can currently continue to meet the Governments need for critical hazardous waste removal and disposal services. Heritage has personnel and equipment to perform the required work during the interim period. Transferring this work to another contractor would incur substantial duplication of cost and adversely impact required performance timeframes. 7. Price/Cost Consideration: The extension will be at the rates specified under the option period of the contract. The prices were competed and evaluated at the time of award. The prices were solicited, evaluated, and determined to be fair and reasonable. An informal analysis indicates that there are no changes in the economy that would lead to substantially lower pricing. 8. Market Research: It is determined that a market survey is impractical, as it would not generate any additional sources capable of satisfying the requirements within the urgent time extension required. As stated above, transferring this work to another contractor would incur substantial duplication of cost and adversely impact the requirement performance timeframes. Any disruption in the current performance timeframes could adversely affect the mission and cause storage violations. 9. Actions Being Taken to Overcome Barriers to Competition: A competitive solicitation with exclusions replacement contract is in process. 10. Other Facts: N/A 11. Contracting Officer Certification: I certify that this justification is accurate and complete to the best of my knowledge and belief. I certify that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief. Approval Based on the foregoing justification, I hereby approve the procurement of a 52.217-8 Extension of Hazardous Waste Services on any other than full and open competition basis pursuant to the authority of 10 U.S.C. 2304(c)(2), subject to the availability of funds, and provided that the services and property herein described have otherwise been authorized for acquisition.

Emergency Permit for Management of Hazardous Waste, Beale Air Force Base (Beale AFB), CaliforniaThe California Department of Toxic Substances Control has issued an Emergency Permit to Beale Air Force Base for the treatment of hazardous waste through open burn and detonation, effective July 3, 2026, and expiring on October 2, 2026. This action authorizes the detonation of fourteen Pyrotechnic Cartridges, Explosive Activated (Airbus Helicopters 863085-00 / 863080-00), and sixteen MK-44/M514 Impulse Cartridges, Explosive Activated, which are currently stored at the US Coast Guard Air Station San Francisco and will be transported to Beale AFB’s secure, closed open burn/open detonation disposal range. These items have expired and degraded, presenting an uncontrolled risk of unpredictable detonation, necessitating immediate and safe disposal under California Code of Regulations Title 22, Division 4.5, Chapter 20, Section 66270.61. The treatment will be conducted exclusively by Explosive Ordnance Disposal (EOD) trained specialists using established military procedures, with additional explosives employed to safely initiate detonation of the waste materials. All operations will occur within a remote, forty-five-acre, fenced, and secured military facility with no unauthorized personnel permitted on base. After treatment, the area will be inspected to confirm no release of hazardous waste, and any untreated materials will be re-treated through repeated detonation as needed. Within ten business days following the permit’s expiration, Beale AFB must submit a final report, signed in compliance with Title 22, CCR Section 66270.11(d), certifying that the treatment area is completely cleared of all residual hazardous waste and that all generated waste has been properly managed. The facility is located at 6425 B. Street, Building 25390, Beale AFB, CA 95903, and all activities are subject to continuous monitoring to ensure operational security and environmental safety. The permit is a regulatory exception granted solely due to safety concerns, and no procurement, pricing, or contractual clauses are involved, as this is an emergency regulatory authorization under state environmental law.

Emergency Permit for Management of Hazardous Waste, Genentech, Inc. South Campus, South San Francisco, CaliforniaThe California Department of Toxic Substances Control has issued an Emergency Permit to Genentech, Inc. South Campus to safely stabilize a single 50-gram container of Sodium Amide that has developed hazardous peroxide formation on its container and cap, posing a significant risk of fire or explosion. Due to the imminent danger this unstable chemical presents to human health and the environment, the permit authorizes controlled chemical treatment to reduce its reactive and ignitable properties before transport. The stabilization process will be conducted by Advanced Chemical Transport LLC, doing business as Republic Services Inc., within a secure exclusion zone accessible only to trained technicians, following strict safety protocols to prevent accidents during handling and treatment. The activity is taking place at Genentech’s facility located at 340 Point San Bruno Boulevard in South San Francisco, California. The Emergency Permit is effective from July 2, 2026, through September 2, 2026, with the requirement that Genentech submit a final report within ten business days after permit expiration. This report must be certified in accordance with state regulations and confirm that all hazardous waste residuals from the treatment have been fully cleared from the area and properly managed. The decision to issue this emergency authorization stems from regulatory authority under Title 22 of the California Code of Regulations, ensuring compliance while addressing an urgent safety threat. Key points of contact for the permitting process include Parisa Khosraviani of DTSC, Daniel Fulford of Genentech, and Kevin Franco of Republic Services, ensuring coordinated oversight and accountability throughout the operation.
