In accordance with FAR Parts 5.2 and 6.302, this stand-alone Special Notice announces the Government's intent to award a sole source purchase order to Kodiak America, LLC (manufacturer) for supplying and delivering a gear box (part no. K00684) assembly and a flange assembly (part no. K00370) for a Kodiak Loader-Mount Snow Blower, Model #LMSC 3644(20)-120 owned by National Park Service, Olympic National Park (OLYM), WA. Kodiak may be arranging to inspect the existing gear box before any new parts ship, in case the cost of repair is going to be shared by Kodiak and Olympic National Park. This is not a request for quotations or proposals and this announcement constitutes the only notice regarding this procurement action. In accordance with FAR 5.207(c)(16)(ii), all responsible sources may submit a capability statement or quotation, which shall be considered by the agency. However, the snow blower parts needed must be Kodiak brand parts as specified herein. Comments and questions regarding this notice may be directed to Phaedra Fuller, Contracting Officer, at contact@example.gov. All comments received by August 31, 2021 will be considered. JUSTIFICATION & APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION for SIMPLIFIED ACQUISITIONS (See FAR 13.106-1) 1. NATURE AND/OR DESCRIPTION OF THE ITEM/SERVICE BEING PROCURED AND ITS INTENDED USE (INCLUDE THE ANTICIAPTED COST): Non-competitive purchase order to Kodiak America, LLC (manufacturer) for ordering a gear box (part no. K00684) assembly in the amount of $28,843.61 and a flange assembly (part no. K00370) in the amount of $1,599.94 for OLYM's Kodiak Loader-Mount Snow Blower, Model #LMSC 3644(20)-120. The order is for parts only, supply and delivery. Price is as-quoted from Kodiak, quote no. 3909 dated 8/3/21 in the amount of $30,443.55, guaranteed for 30 days. 2. SOLE SOURCE JUSTIFICATION AUTHORITY AND RATIONALE: Authority for this justification is FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements. EXPLAIN: Kodiak America, LLC is the only manufacturer of Kodiak brand heavy equipment and all Kodiak brand parts and equipment accessories. Kodiak sells the machinery, spare parts, makes repairs. The identified parts/assemblies are required to make the park-owned Kodiak snow blower functional for use in winter snow removal operations. Kodiak America, the manufacturer of the snow blower, is the only known source for replacement parts. There is an urgency component to this requirement, to award a purchase order as soon as possible due to the COVID-19 pandemic which has been causing delays in manufacturing and longer delivery lead times. The Kodiak manufactured snow blower parts need to be ordered by mid-August so that they will be received in time for OLYM mechanics to make the necessary repairs before Fall/Seasonal weather starts and the equipment is needed on park roadways (sometimes as early as mid-September along Hurricane Ridge Roadway). The Government would be harmed if the purchase order was delayed because that would affect lead time for delivery of parts needed. Kodiak may decide to pick up the current gear box from OLYM for the purpose of troubleshooting what's wrong, and may offer a discount for the replacement depending upon what's found, so the total price paid may actually be less than originally quoted. 3. MARKET RESEARCH (PLEASE EXPLAIN THE RESULTS OR WHY ONE WAS NOT PERFORMED. STATE WHETHER ANY OTHER OFFERS WERE RECEIVED OR ANYONE EXPRESSED INTEREST): An extensive web search revealed no alternative sources for Kodiak parts. Neither Kodiak manufactured parts from an alternate vendor nor after-market options could be found. The parts needed are also not available through the GSA Advantage online storefront.Kodiak America, LLC located in Idaho, is the only source of supply for buying Kodiak machinery, spare parts, and accessories nationwide. No offers have been received nor has anyone expressed any interest. 4. IF THIS IS A DETERMINATION FOR SOLE SOURCE, THE CONTRACTING OFFICER CERTIFIES: (a) Only one source is available, or urgent and compelling circumstances exist, and (b) The anticipated price will be determined fair and reasonable using the price analysis techniques described in FAR Part 13.106-3(a). APPROVALS: /s/ John Willoughby, Facility Management-Roads Supervisor, OLYM (8/17/21) /s/ Jeff Doryland, Deputy Chief of Facility Management, OLYM (8/18/21) CONCURRENCE BY CONTRACTING OFFICER: /s/ Phaedra Fuller, OLYM (8/23/21)
