The US Army Corps of Engineers (USACE), Engineer Research and Development Center (ERDC) contracting office plans to award a sole source contract to MMC Materials, located in Jackson, Mississippi, for the replacement of a concrete mixer drum and drive unit on a concrete mixer truck owned by MMC Materials. These components became inoperative due to the failure of a highly specialized ultra-high performance concrete mix that MMC was manufacturing specifically for the Government. Since the Government was responsible for the concrete mixture produced in MMC’s truck, it is also responsible for the failure of these components. MMC Materials is uniquely positioned to supply the required mixer drum and drive unit because these are custom-built for their trucks. This procurement will be executed under simplified acquisition procedures as set forth in FAR 13.106-1(b), emphasizing a sole source award without competitive solicitation. Although this notice is not a solicitation or request for quotes, other capable vendors have the opportunity to submit capability statements, proposals, or quotations to the designated Contract Specialist by the specified deadline of July 23, 2013. Interested parties can forward their information to the Government representative for consideration; however, due to the specialized nature and exclusivity of the equipment needed, the contract is intended to be awarded solely to MMC Materials.

US Army Corps of Engineers (USACE), Engineer Research and Development Center (ERDC) Contracting Office intends to issue a sole source award to MMC Materials located at 815 W Fortification Street, Jackson, MS, 39203 for concrete mixer drum and drive unit that will replace the concrete mixer drum and drive unit that was rendered inoperative on a concrete mixer truck owned by MMC Materials. The mixer drum and mixer drive were rendered inoperative due to the failure of a highly specialized ultra-high performance concrete mixture that MMC was producing for the Government. The Government was responsible for the mixture that MMC Materials was producing in their mixer truck; therefore, the Government was responsible for the failure, not MMC Materials. MMC Materials is the only vendor that can provide the mixer drum and drive unit for their custom built trucks. The intent of this procurement is to award based on sole source requirement. This purchase will be made under simplified acquisition procedures in accordance with FAR 13.106-1(b). This notice is neither a request for quote nor a solicitation for offers. All responsible sources may submit a capability statement, proposal, or quotation to the Contract Specialist by 12:00 PM CST, 23 July 2013. Interested parties may submit information for consideration by the Government to contact@example.gov.
