65--Intent to Sole Source Endoscopy software licenses

The Greenville, NC VA Health Care Center plans to issue a firm fixed price, sole source Purchase Order to Olympus America for the renewal of software licenses and annual maintenance of the Endoworks software system currently in use. This transaction will be treated as a commercial item purchase using the Federal Acquisition Regulation (FAR) Part 12 and Simplified Acquisition Procedures under FAR Part 13. Market research has determined that Olympus America is the sole provider capable of delivering the necessary support and maintenance because the software is proprietary. As such, this notice is not a solicitation for competitive quotes but rather a preemptive designation of sole source procurement. Although competitive quotes are not being sought, contractors interested in performing this work may submit a narrative detailing their capabilities and qualifications to the designated contract specialist by a specified deadline. The government will evaluate these submissions only to decide whether the procurement should be opened to competition. Ultimately, the decision to proceed with a sole source award or a competitive process is at the sole discretion of the government. This procurement relates to North American Industry Classification System (NAICS) code 339113 and is intended to ensure the continued functionality and support of the Endoworks endoscopy software at the VA Health Care Center.
