The Department of Veterans Affairs at the Dayton VA Medical Center plans to enter into a sole source contract with Pulmonetic Systems for the acquisition of seven LTV1200 ventilators along with their necessary parts and equipment. This procurement aims to enhance emergency preparedness, specifically to address a potential pandemic flu outbreak. The agency is justified in using a sole source approach under the statutory authority of 41 U.S.C. 253(c)(1) and the Federal Acquisition Regulation (FAR) 6.302-1, on the grounds that Pulmonetic Systems is the only responsible source capable of meeting the agency’s requirements. This contract will not be competed, and no solicitation will be issued; however, interested firms that believe they can meet the requirements may submit written notification to the Contracting Officer within five days of the publication date, with detailed evidence supporting their capability to fulfill the contract conditions. The deadline for responses is September 18, 2007, at 3:00 PM PST. The government reserves the right to decide whether or not to pursue competitive procurement based on these responses. Failing any responses, the VA will proceed with negotiating directly with Pulmonetic Systems for this urgent procurement.
