The Department of Veterans Affairs intends to negotiate a sole source, firm-fixed-price contract with Brainlab, Inc. for an upgrade to the Exactrac Camera Package, facilitating the transition from an existing linear accelerator to a Varian TrueBeam system at the Richmond VA Medical Center. Brainlab is the exclusive manufacturer and service provider for the Exactrac system, which is essential for high-precision radiation treatments involving infrared cameras, reflective markers, and stereoscopic x-ray imaging to ensure accurate patient positioning. This procurement includes various upgrade components, installation, and service visits to enable the relocation and compatibility of the Exactrac system with the new linear accelerator, a process requiring specialized knowledge and equipment only Brainlab possesses. The sole source determination is based on Brainlab’s unique position as the only vendor capable of supplying the proprietary parts and providing the necessary de-installation, reinstallation, and verification services. Market research confirmed no other suppliers exist that can meet these requirements without incurring significantly higher costs, as alternatives would require full system replacements. The Department invited other responsible sources to submit capability statements by a specified deadline to determine if competition would be beneficial, but the proprietary nature of the equipment and services strongly supports awarding the contract solely to Brainlab. This effort is conducted under NAICS code 339113, with a business size standard of 750 employees, and managed through the Richmond VA Medical Center contracting office.

DEPARTMENT OF VETERANS AFFAIRS Justification for Brand Name Only Single Source Awards IAW FAR 13.106-1 Acquisition Plan Action ID: 36C246-22-AP-XXXX Contracting Activity: Department of Veterans Affairs, VISN 06, Richmond VA Medical Center 1201 Broad Rock Blvd. Richmond VA, 23249. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: The Brainlab Exactrac system is used for high-precision radiation treatment to lesions such as brain tumors, spinal tumors, and other well-defined lesions of the body. It uses a combination of infrared cameras with reflective markers and dual stereoscopic x-ray imaging to locate and monitor the patient s position during radiation treatment. This purchase provides the upgrades and labor needed to move our existing Exactrac system from its current location (a linear accelerator being decommissioned) to our new TrueBeam linear accelerator. Estimated Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: This project requires the vendor to move existing systems between two radiation vaults and replace parts that are unique to the interface between the Exactrac system and the specific linear accelerator it is being used in conjunction with. Brainlab, as the manufacturer of the Exactrac system, is the only vendor capable of supplying the necessary parts and performing the de-installation / reinstallation of the equipment, and verifying its proper operation. Only Brainlab supplies the parts required for the Exactrac system. Alternative vendors would require a total replacement resulting in 10x the costs. Only Brainlab personnel are properly trained to be able to remove the existing parts of the Exactrac system from their current location and install them in the new location (renovated radiation vault and new linear accelerator installation). Description of market research conducted and results or statement why it was not conducted: Querying the Government-wide database (VIP, NAC, FPDS, &World Wide Web) of contracts and other procurement instruments revealed the OEM Brainlab. I contacted Brainlab who told me that they are the sole proprietary of this equipment and the only company that can perform preventive maintenance, do replacement parts, and upgrades to their system. They also sent a proprietary letter to back up their statement.
