AI Contract Overview

The Department of Veterans Affairs, VISN 11 Contracting Activity, intends to negotiate a sole source contract under Simplified Acquisition Procedures for the purchase of BIOFIRE COVID testing stock specifically designed for the Microbiology Laboratory at the Battle Creek VA Medical Center. The contract is based on the unique capabilities of Biofire Diagnostics, the sole manufacturer and distributor of the BIOFIRE RP2.1 PANEL, which is necessary for real-time PCR nucleic acid testing to rapidly detect COVID-19, Influenza A and B, and potentially other pathogens as testing options expand. This sole source acquisition is justified because the existing laboratory equipment only supports Biofire-brand reagents and supplies, and alternate products cannot communicate or integrate with the current system, making Biofire the only viable supplier to ensure uniform, accurate test results for critical patient care. The contract, anticipated as a firm fixed price agreement without option years, is aligned with FAR 8.405-6(a)(1)(B), citing that only one source can meet the required level of quality due to the highly specialized nature of the equipment and supplies. The solicitation number for this procurement is 36C25022Q0868, and the associated NAICS code for the medical equipment is 334516. The Government has indicated its intention to solicit and negotiate exclusively with Biofire Diagnostics and has requested any opposition to this sole source determination be submitted by July 20, 2022, 4 PM EDT. The contracting office managing this requirement is based in Dayton, Ohio, with Brooke Hansen serving as the point of contact. This notice does not constitute a Request for Proposal but rather an official Notice of Intent to Sole Source for this critical laboratory testing equipment.
