The purpose is to establish a one-time purchase with a qualified supplier capable of meeting detailed technical specifications, including sensors for multiple gases, communication capabilities, weatherproof design, and compatibility with existing EPA and departmental equipment. The award will be granted to the lowest responsive and responsible bidder that meets all specifications, with a response deadline of October 15, 2025. The process emphasizes strict communication protocols, requiring all inquiries to be directed through designated contacts and prohibiting direct contact with state staff during the solicitation period. The contract also incorporates several mandatory compliance requirements, including tax and legal attestations. Suppliers must submit tax compliance forms verifying their eligibility and absence of tax issues, and provide affidavits confirming their use of the federal E-Verify program to ensure lawful employment practices. The procurement process is governed by Georgia statutes and constitutional provisions that restrict certain contract terms, such as indemnification clauses, warranties, venue selections, and waiver of sovereign immunity, which are deemed non-negotiable. Additional documentation details the legal obligations of contractors, including adherence to state law, restrictions on contract terms, and the importance of timely submission of affidavits and tax forms to ensure eligibility. Overall, the contract aims to secure reliable, compliant equipment through a transparent, legally compliant procurement process aligned with Georgia’s procurement regulations.
