The Department of Veterans Affairs at the Dayton VA Medical Center plans to pursue a sole source contract negotiation with Advanced Sterilization Products, a subsidiary of Johnson and Johnson Health Care Systems, for an EvoTech Endoscope Cleaner and Reprocessor (ECR) System including all necessary parts and supplies. The decision to proceed with a sole source procurement is based on the determination that only this vendor can meet the specific requirements of the agency, as authorized under federal procurement statute 41 U.S.C. 253(c)(1) and FAR 6.302-1. This approach eliminates the issuance of a competitive solicitation, emphasizing that the contract will be awarded without competitive quotes unless other qualified sources come forward. Although this notice is not a request for competitive proposals, any company believing it can fulfill the contract requirements has the opportunity to submit a written notice along with supporting evidence within 10 days of the notice’s publication. This submission must demonstrate the ability to perform the contract requirements in detail. The Department of Veterans Affairs will review any submissions to determine if a competitive procurement is warranted, but retains full discretion to proceed with Advanced Sterilization Products if no viable alternatives are identified by the deadline of September 16, 2007, at 3:00 pm PST. If no competing responses are received, negotiations will continue exclusively with Advanced Sterilization Products to fulfill the medical center’s endoscope cleaning needs.
