S--Marine Corps Air Station Miramar (San Diego, CA) will award a twelve month cable television contract to Time Warner, Inc. Time Warner is the only authorized cable television provider to MCAS Miramar.

THE FOLLOWING J&A IS PROVIDED FOR THIS CONTRACT: UNITED STATES MARINE CORPS HEADQUARTERS MARINE CORPS AIR STATION MIRAMAR PO BOX 452007 SAN DIEGO CA 92145-2007 Control No: 11-01 JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION 1. Identification of Agency and Contracting Activity. This requirement is for the 3rd MAW of the Marine Corps Air Station Miramar, San Diego, California (MCAS Miramar), the Contracting Activity is the Miramar Contracting Office. 2. Nature/Description of action. The purpose of this action is to issue a sole source contract to TIME WARNER, INC. The contract is to provide TELEVISION CABLE SERVICE. This system will enhance the safety of personnel, save lives and preserve MCAS Miramar mission readiness. 3. Description of Supplies/Services. This contract is to provide CABLE SERVICE to multiple locations aboard MCAS Miramar, using customer-owned cabling. 4. Identification of Statutory authority Section 4202 of the Clinger-Cohen Act of 1966 – Only one responsible source and no other supplies or services will satisfy requirements (sole source). 5. Demonstration of the Contractor’s unique qualifications or Rationale for Use of the Authority Cited. The primary rationale for this sole source is based upon a follow-on contract M67865-10-P-0011, a contract for cable services awarded in FY10 to TIME WARNER CABLE. The authority to issue this contract sole source, is by Governmental entity; whereas, the City of San Diego is the single agent for telecommunications and cable franchise licensing within the city limits of San Diego, CA. MCAS Miramar lies within the city limits of San Diego, CA. The City of San Diego has only authorized Time Warner Cable to operate in the geographic area encompassing MCAS Miramar. No other cable provider is allowed to operate in this designated area. 6. Efforts Made to Solicit Potential Sources. The City of San Diego verified that Time Warner Cable was the only operator allowed to franchise its operation in the geographic area bordering MCAS Miramar. 7. Determination of Fair and Reasonable Cost. The Contracting Officer has determined that the price for cable service offered by Time Warner Cable is consistent with Fair and Reasonable Costs. Time Warner did not raise rates from the previous contract period. 8. Description of Market Research Market research was comprised of telephone inquiries to the City of San Diego Department of Communications, which verified the vendor’s status as a sole source for the geographic area surrounding MCAS Miramar. 9.
