The Small Business Administration (SBA) issued two technical corrections to its final rule amending part 1 of the Small Business Size Regulations (13 CFR 121), initially published on May 21, 2004. The first correction modifies the definitions of affiliation and employees, as well as procedural and technical aspects across several SBA programs. These amendments affect all solicitations issued and financial applications submitted on or after June 21, 2004, including follow-on contracts and size representations submitted with orders post-December 21, 2004. Additionally, these changes apply to novation and change-of-name agreements executed in accordance with FAR 42.12 from the same December 21, 2004 date, allowing ongoing novations to proceed without disruption. The second correction adjusts regulations related to the Historically Underutilized Business Zone (HUBZone) Program, specifically clarifying who may initiate a size protest or determination. These corrections were published in the Federal Register on July 26 and July 30, 2004, respectively. They provide clarity on the application and enforcement of size standards and affiliation rules to ensure consistent treatment across SBA programs and contracting actions. The contract data references these changes under solicitation number Reference-Number-20040810-part121techcorr, associated with NAICS code 926110. SBA recently made two technical corrections to the final rule amending part 1 of its Small Business Size Regulations (13 CFR - 121). The final rule itself appeared in the Federal Register on May 21, 2004 (69 FR 29192). Specifically -- (1) The final rule amended the definitions of affiliation and employees and made procedural and technical amendments to cover several of SBA's programs. These amendments apply to all solicitations issued on or after June 21, 2004, as well as all applications for financial or other assistance pending as of or submitted to the SBA on or after June 21, 2004. The amendments apply to all follow-on or contract renewals and size representations submitted as part of an order issued pursuant to a contract (if the Contracting Officer has reserved the order for small businesses and requested a size certification) on or after December 21, 2004. The amendments apply to all novation and change-of-name agreements executed pursuant to FAR 42.12 on or after December 21, 2004. The SBA believes it is necessary to delay applicability of this rule for such situations because some novations may be in the progress of completion, but not yet completed at this time and this change in applicability date will not hinder the progress of such agreements. This technical correction was published in the Federal Register on July 30, 2004. It is available for reading and/or download at TEXT PDF; (2) The final rule also amended the regulations that govern the Historically Underutilized Business Zone (HUBZone) Program. The corrected provision concerns who may initiate a size protest or initiate a size determination. The correction appeared in the Federal Register on July 26, 2004. Administrative Lease Authorization and Regulatory Compliance SupportThe California State Lands Commission is authorizing an administrative lease for a 20-year general lease agreement to support public agency use of an existing pedestrian bridge that crosses sovereign lands. This action involves formalizing the long-term operational use of the structure while ensuring compliance with state regulatory frameworks, including a determination of eligibility for a CEQA categorical exemption to avoid full environmental review. The lease pertains specifically to infrastructure already in place and is intended to provide legal clarity and continuity for public access purposes without requiring new construction or substantial modification. The activity falls under NAICS code 926110, indicating it is a government administration function related to land and natural resource management. The project is centered in Red Bluff and is part of a broader effort to maintain public infrastructure on state-held lands while streamlining regulatory processes through established exemptions. The administrative action requires internal review and documentation to confirm that the lease meets statutory criteria for categorical exemption under CEQA, ensuring no significant environmental impact from continued use. No new solicitation or competitive bidding is involved, as the lease supports an existing facility under the jurisdiction of the California State Lands Commission. The contract serves as a procedural and regulatory support mechanism to sustain public access and uphold compliance with state land management policies over the 20-year term.
