The U.S. Small Business Administration (SBA) intends to update its Small Business Size Standards by incorporating the Office of Management and Budget's 2002 revisions to the North American Industry Classification System (NAICS) into its size standards table. These revisions affect industries in six of the twenty NAICS sectors and result in minor changes to certain size standards. On August 13, 2002, SBA published both a direct final rule and a proposed rule in the Federal Register to implement these changes. The agency considers the updates noncontroversial and anticipates no adverse comments. If no negative feedback is received by September 12, 2002, the direct final rule will take effect on October 1, 2002. Otherwise, the SBA plans to withdraw the direct final rule and address all comments in a subsequent rulemaking. The Federal Register notices originally contained formatting errors related to the omission of dollar signs in monetary-based size standards, but these errors do not impact the actual size standards. Corrections will be issued and made available on the SBA website. Interested parties were invited to review the proposed and direct final rules online and submit comments by the specified deadline to ensure their views are considered in the final decision. The contract reference relates to the amendment effort focused on maintaining the accuracy and relevance of small business classification criteria as per the new NAICS guidelines.

Full Description

The U. S. Small Business Administration (SBA) plans to amend its Small Business Size Regulations by incorporating the Office of Management and Budget's (OMB) 2002 modifications of the North American Industry Classification System (NAICS) into its table of small business size standards. These modifications are limited to industries in six (6) of the 20 NAICS Sectors. The modifications result in a small number of size standard changes to certain NAICS activities. On August 13, 2002, SBA published in the Federal Register both a direct final rule and a proposed rule to achieve this result. SBA believes that the subject of these rules is noncontroversial and routine, and SBA anticipates no adverse comments. If SBA receives no adverse comments to the direct final rule by September 12, 2002, it will take effect on October 1, 2002. If SBA receives negative comments to the direct final rule, SBA will withdraw it. SBA will address the comments to the direct final rule together with any comments to the proposed rule that it receives in a later final rule. Note: These Federal Register notices contained a number of formatting errors, primarily the deletion of dollar signs ($) that indicate monetary based size standards. The Federal Register will publish a correction in the near future, but the changes do not affect the size standards themselves. SBA will include the corrected Federal Register notices on this page after they are published. Comments are due by September 12, 2002. Interested parties can read the direct final and proposed rule at http://www.sba.gov/size/indexwhatsnew.html
