99 -- Sole Source for the International Broadcast Rights for Radio Programming

This is a notice of intent to issue an order to Excelsior Radio Networks ? Dial Global, on a sole source basis under the authority of FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, 10 U.S.C. 2304(c)(1) and is for the international television programming broadcast rights. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. A determination by the Government not to compete with this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. Provisions and clauses are those in effect through Federal Acquisition Circular 2005-23 effective 26 DEC 2007 and latest DAC (DFARS Change Notice ? ?DCN?) is 20 DEC 2007. . (1) FAR 52.212-1 (Instructions to Offerors ? Commercial Items) (JAN 2005): (a) Re para (a): NAICS 515111; small business size standard is $6.5M.
