The City of San Diego is amending its Accessory Dwelling Unit and Junior Accessory Dwelling Unit regulations to align with recent state legislation and guidance from the California Department of Housing and Community Development. These changes revise key parameters including minimum and maximum unit sizes—800 square feet for ADUs and 500 square feet for JADUs—along with setbacks, structure height limits, parking requirements, and owner-occupancy rules. The amendments implement Senate Bill 1211, which permits ADUs on lots with existing or proposed multifamily structures, and Assembly Bill 1033, which allows ADUs to be sold or conveyed as separate parcels. Fire safety standards are strengthened through mandatory automatic fire sprinkler installation in all new ADUs and revised setback requirements in High and Very High Fire Hazard Severity Zones, including the need for evacuation route access. The ADU Home Density Bonus Program is restricted in certain RS-1 zoning districts unless the property is located in a designated Opportunity Area with residential land use planning and qualifies under the California Tax Credit Allocation Committee criteria. Additional changes include higher penalties for violations, new community enhancement fees, and the elimination of short-term rentals under 30 days for ADUs. The City Planning Department is the lead agency overseeing these regulatory updates, with administrative acceptance finalized through the San Diego County Clerk's Office after filing a certified Notice of Exemption under CEQA. The only financial transaction referenced is a $50 CEQA filing fee, reflecting the non-procurement nature of this action, which focuses solely on updating municipal code provisions to comply with state mandates and public safety objectives.
