NASA MSFC has a requirement for continuation of Architect-Engineer (A-E) environmental remediation oversight at the Santa Susana Field Laboratory (SSFL), Ventura County, California, as required by the two agreements Consent Order for Corrective Action (COCA) and Administrative Order on Consent for Remedial Action (AOCOCA) between NASA and DTSC. NASA MSFC intends to procure these services from the State of California Department of Toxic Substances Control (DTSC) pursuant to FAR 6.305-5, which implements the authority of 10U.S.C. 2304(a)(5) when a statute expressly authorizes or requires that the acquisition be made through another agency or from a specified source. This authority is based upon the authority of: (1) The COCA executed on August 16, 2007, signed by the NASA MSFC Center Director and SSFL Project Director of DTSC. (2) The AOCOCA for Remedial Action executed on December 6, 2010, signed by the NASA/MSFC Assistant Administrator of Office of Strategic Infrastructure and the DTSC Acting Director. By law, DTSC is the governing remediation regulatory agency. For over fifty years, the SSFL was utilized for the development, test and validation of various rockets engines, fuels and solvents. The fuels and solvents were used to test and maintain the propulsion systems and testing facilities which have over the years collected in the ground water and caused contamination. Federal and State environmental laws require remediation of the affected areas followed by a period of monitoring. California law requires that remediation be sustained, without cessation, through completion. This effort will provide professional engineering with experience in investigation and clean-up, natural resources specialists, cultural resources specialists, chemists, risk assessors, community relations specialists, hydrogeologists, regulatory compliance, remediation services needed to maintain compliance with state and federal environmental regulations, and respond to legally enforceable Consent Orders signed with Department of Toxic Substance Control (DTSC). The Government does not intend to acquire a commercial item using FAR Part 12. Interested organizations may submit their capabilities and qualifications to perform the effort in writing to the identified point of contact not later than 4:00 p.m. local time on April 26, 2019. Such capabilities/qualifications will be evaluated solely for the purpose of determining whether or not to conduct this procurement on a competitive basis. A determination by the Government not to compete this proposed effort on a full and open competition basis, based upon responses to this notice, is solely within the discretion of the Government. Oral communications are not acceptable in response to this notice. All responsible sources may submit an offer which shall be considered by the Agency. NASA Clause 1852.215-84, Ombudsman, is applicable. The Center Ombudsman for this acquisition can be found at http://prod.nais.nasa.gov/pub/publibrary/Omb.html.
