NOTICE OF INTENT-SOURCES SOUGHT



The Defense Information Systems Agency /Defense Information Technology Contracting Organization intends to negotiate a sole source contract with Motorola Solutions, Inc. A sole source Justification & Approval document is being coordinated and, upon approval, a copy of it will be posted to SAM.gov to comply with the public display requirements of FAR 6.301.



The proposed contract action is for Army CONUS Enterprise (ACE) Land Mobile Radio (LMR) - Motorola Original Equipment Manufacturer (OEM) Extended Warranty and Maintenance Support for Fort Novosel, Alabama, and Holston Army Ammunition Plant (HAAP), Tennessee. The period of performance is September 30, 2026, September 29, 2027, with one, one year option period.



The requirement provides continued OEM extended warranty and associated maintenance support for Government-accepted Motorola LMR equipment and components covered by the applicable OEM warranty entitlement. Support includes OEM warranty administration; OEM technical support; diagnosis of covered equipment failures; repair or replacement of covered components; Return Material Authorization  processing; warranty-related software and firmware updates made available under OEM entitlement; replacement components required to fulfill warranty obligations; applicable licensing; transportation and shipping associated with warranty actions; and coordination and tracking of warranty actions through closure.



The contractor is required to provide OEM-backed technical and lifecycle support to ensure the continued operation of the existing Motorola LMR systems and maintain warranty coverage throughout the period of performance.



At this time, the incumbent contractor Motorola Solutions, Inc.(Motorola) is the only source capable of fulfilling the requirement for OEM extended warranty and maintenance support for the existing Motorola LMR systems and associated equipment. As the OEM, Motorola, possesses the proprietary technical data, system-specific knowledge, OEM repair capabilities, software and firmware support, replacement components, licensing, and warranty authority necessary to provide continued OEM-backed coverage for the installed Motorola equipment.



Awarding this requirement to another source would not provide the required Motorola OEM extended warranty coverage and could jeopardize the Government’s ability to maintain OEM-supported maintenance, compatibility, and lifecycle support for the existing Motorola LMR infrastructure and equipment. Such an outcome would introduce significant risks to mission-critical communications, operational readiness, and the security of Army Enterprise LMR systems.



The statutory authority for other than full and open competition is 10 USC 2304 (c) (1), as implemented by FAR 6.103-1, only one responsible source and no other supplies or services will satisfy agency requirements. Companies who believe they can provide this service must indicate their interest in writing within 15 days of this notification and include a detailed capability statement.  No reimbursement for any cost connected with providing capability information will be provided.  All responsible sources will be considered in evaluating the determination to issue a sole-source contract.  Quotations or proposals received in response to this notice cannot be accepted since this synopsis cannot be considered a request for quote or a request for proposal.  A solicitation will NOT be posted to SAM.gov due to the sole source nature of the requirement.



The North American Industry Classification System (NAICS) code 334210, Telephone Apparatus Manufacturing, will be used for determining company size status.
