AT&T commercial subscriptions

The Department of Commerce, through the NTIA/FirstNet Authority, has awarded a sole-source contract to AT&T for commercial wireless subscriptions under GSAM 538.71, which permits non-competitive procurement when only one source can meet the government’s requirement. This acquisition is driven by the unique and non-replicable capabilities of AT&T as the exclusive operator of the Nationwide Public Safety Broadband Network (NPSBN), which provides critical services such as priority and preemption, FirstNet Push-to-Talk interoperability with Land Mobile Radio systems, and dual-SIM testing environments that are unavailable from any other provider. The purpose of the contract is to support comprehensive evaluation and testing of FirstNet performance against commercial networks, including coverage assessment, roaming validation, mission-critical application behavior, and network interoperability in real-world conditions, with performance designated to occur in Columbia, Maryland, while administrative oversight is managed from Reston, Virginia. No competitive solicitation was conducted, and no formal evaluation factors, scoring criteria, or price negotiation protocols beyond verification of fairness and reasonableness using GSA schedule pricing were applied. The contract does not include detailed line-item pricing, delivery schedules, packaging requirements, inspection protocols, or special clauses, as it relies on the statutory and operational exclusivity of AT&T’s FirstNet infrastructure. The contracting officer, Brandon Payne, is the primary point of contact, and while the procurement leverages federal acquisition frameworks, it does not involve small business set-asides, socioeconomic certifications, security clearances, or contract options. The absence of specified contract value, delivery terms, or invoicing procedures reflects its nature as a service-based order justified solely by technical necessity and statutory exclusivity under the Middle Class Tax Relief and Job Creation Act of 2012.
