AI Contract Overview
This solicitation, identified as number 2100639, is issued by the Dallas Area Rapid Transit Authority (DART) for the procurement of a 30 Amp Circuit Breaker. The procurement process is managed through the BONFIRE portal, where interested vendors must register to access the specific BidTable and detailed project requirements. The submission deadline is set for August 27, 2026. This is a civilian procurement governed by the local terms and conditions of the Dallas Area Rapid Transit Authority rather than standard federal FAR-based clauses. The place of performance is located in Texas, and the contract requires strict adherence to delivery schedules, as time and rate of deliveries are considered essential to the order. Vendors must provide quotes based on FOB Destination shipping terms, ensuring that all freight costs are included in the overall price. Payment terms are Net 30, with invoices submitted in triplicate via email to the designated DART accounts payable address. The contract includes several critical compliance requirements, such as certifications regarding anti-boycott laws, non-association with foreign terrorist organizations, and adherence to equal opportunity and subcontractor diversity standards. Additionally, the Authority is exempt from all Texas state and local taxes, and the contractor is prohibited from assigning the contract without prior written consent. While specific evaluation factors and contract values are not disclosed in the general terms, the seller is responsible for ensuring all goods meet merchantable quality and conform to all specified technical drawings and part numbers.

Full Description
--- **PURCHASE ORDER TERMS AND CONDITIONS** -- All purchase orders are subject to Dallas Area Rapid Transit Authority's Terms and Conditions. The complete PO Terms and Conditions PDF is available for download in the "Supporting Documentation" section below.
**Freight Terms Notice -** Please ensure that all bids/quotes reflect FOB Destination shipping terms with the freight cost included in the overall price. DART does not typically accept FOB Origin or Prepay and Add terms.
**Delivery Terms Notice -** Time and rate of deliveries are of the essence of this order. Seller's failure to deliver at the time and rate specified shall be the basis for rejection and default termination by the Authority (*Dallas Area Rapid Transit Authority*).
**Payment Terms Notice -** All vendors are advised that DART's payment terms are Net 30. Invoices shall be submitted (contact@example.gov) in triplicate (one copy shall be marked 'Original"), unless otherwise specified, and shall contain the following information: purchase order number; item number; purchase order description of supplies, services, or construction; sizes; quantities; unit prices; and extended totals. Unless otherwise specified, payment will be made on partial deliveries accepted by the Authority when the amount due on such deliveries so warrants. *Invoices will be paid 30 days from receipt of the invoice or 30 days from receipt of the order, whichever is later, unless other payment terms have been agreed upon in writing.*
**Termination for Default Notice -** The Contracting Officer may by written notice terminate this order, in whole or in part, for failure of the Seller to perform any of the provisions hereof within the time periods specified. In such event, the Seller shall be liable for damages, including the excess cost of reprocuring similar supplies or services or completing construction; provided that, if (i) it is determined for any reason that the Seller was not in default, or (ii) the Seller's failure to perform is without his and his subcontractor's control, fault, or negligence, the termination shall be deemed to be a termination for convenience under paragraph 12. As used in this provision, the term "subcontractor" and "subcontractors" means subcontractors, vendors, and suppliers at any level.
