AI Contract Overview
The National Institutes of Health Clinical Center intends to award a sole source service agreement to Becton, Dickinson & Company for the maintenance and repair of three specialized laboratory instruments: the BD FACSLyric with 3 laser configuration, the BD Universal Loader, and the BD FACSDuet. These systems are critical to the operations of the Department of Laboratory Medicine, supporting patient care and advanced research through precise cell-by-cell biomarker analysis. The contract covers a one-year period from August 25, 2026, to August 24, 2027, with specific serial numbers tied to each device, ensuring targeted service coverage. Only the original equipment manufacturer is eligible to provide the necessary proprietary maintenance, certified technical support, and authentic replacement parts, as third-party services could compromise system integrity and patient outcomes. The acquisition is being conducted under FAR 13.106-1(b)(1), allowing for non-competitive procurement due to the exclusive technical expertise and proprietary nature of BD Biosciences' support capabilities. While no formal solicitation is being issued, interested parties may submit a capability statement detailing their technical capacity, proof of OEM authorization, and relevant past performance to demonstrate they can meet the government’s requirements. Submissions must be received electronically by May 14, 2026, at 7:00 AM EST, and all responses must reference the POTS number 26-003491. The government retains full discretion in determining whether to proceed with the sole source award or consider alternative sources based on the submitted capability statements.

The NIH Clinical Center intends to award a sole source contract to Becton, Dickinson & Company (BD Biosciences) for a one-year service maintenance agreement for BD FACSLyric, BD Universal Loader, and BD FACSDuet instruments. These systems support critical patient care and laboratory operations within the Department of Laboratory Medicine. The serial numbers covered under this agreement are listed as follows:
- BD FACSLyric 3 laser Serial: Z662383000112
- FACSLoader Serial: Z662462000206
- BD FACSDuet Serial#: 9230010101
The anticipated period of performance is 08/25/2026 – 08/244/2027.
Background
The Department of Laboratory Medicine serves as the clinical laboratory of the NIH Clinical Center. It provides laboratory support for patient care and research protocols and performs research and training in disciplines of Clinical Pathology. This includes the Flow Cytometry section of the Hematology service that provides physical and chemical quantification of biomarkers of interest to the service on a cell-by-cell basis. In doing so, DLM provides state-of-the-art laboratory testing in support of Clinical Center patient care and serves as a center of excellence in research and training in laboratory medicine, particularly in areas that utilize the unique strengths of the National Institutes of Health.
Rationale:
BD Biosciences is the original equipment manufacturer and the only vendor capable of providing proprietary maintenance services, certified support, and compatible parts for the required equipment. Use of non-OEM services would risk system performance and patient care operations.
Authority
This acquisition is being conducted in accordance with:
