Subj: BRAND NAME JUSTIFICATION TO ACQUIRE BIOPAC BRAND BIOMEDICAL DATA ACQUISITION SYSTEM ADD-ONS (Purchase Request 1301006844) Identification of the agency and the contracting activity, and specific identification of the document as a - Limited Source Justification. This is a brand name justification. Contracting activity is the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD), 110 Vernon Avenue, Panama City, FL 32407-7001 (Contracts Department Code 02). Nature and/or description of the action being approved. This action will award a firm fixed price purchase order, on a brand name basis, to acquire the BIOPAC biomedical data acquisition equipment. The equipment will be used upgrade the base system called the BIOPAC MP150 (we currently own 2 of these systems), and it is data acquisition system used to collect human physiological data for human performance research. A description of the supplies or services required to meet the agency's needs (including the estimated). The following items are being acquired: Description Qty. CO2 Measurement Module (CO2100C) 1 Oxygen Measurement Module, C-Ser (O2100C) 1 Pneumotach Transducer (TSD107B) 1 Differential Amplifier Module, C-Series (DA100C) 3 Gas Sampling Interface Kit (AFT20) 1 Smooth Bore Tubing, 3m/35mmID (AFT7-L) 2 Face Mask, Medium, w/T valve (AFT25-2) 1 Face Mask, Large, w/T valve (AFT25-1) 1 Differential Pressure Transducer 12.5cm H20 (TSD160B) 1 Differential Pressure Transducer 25cm H20 (TSD160C) 1 Differential Pressure Manometer (AFTCAL-160) 1 The estimated value of this procurement is expected to exceed the Micro Purchase Threshold of $10,000.00 but less than the Simplified Acquisition Threshold of $250,000. The Government's minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. This procurement will be funded with fiscal year 2022 Operation and Maintenance, Navy (OMN) funds. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor's unique qualifications to provide the required supply or service. 10 U.S.C. 2304(c)(1). Application for brand name description FAR 6.302-1(c). Only BIOPAC brand equipment will meet this requirement for the following reasons. The items being acquired will be used to upgrade the base system, the BIOPAC MP150. This upgraded system is required to complete tasked warfighter and human performance research at NEDU. The BIOPAC brand is currently being used as the primary data-acquisition system for physiology research of this type and by purchasing these add-ons, the Government is able to maintain consistency, reduce training costs, and reduces system complexity. Furthermore, by expanding the capabilities of the BIOPAC Systems currently in use, the current supporting peripherals will be interchangeable, thus saving the Government money. As such, the Government does not expect significant savings through competition and does expect significant and unacceptable delays that will negatively impact this requirement. Use of alternate equipment may introduce new or change existing parameters that may damage or reduce the operational effectiveness of the BIOPAC MP150, therefore, it is imperative that BIOPAC brand equipment is acquired. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b). The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (such as considering price, special features, administrative costs) to meet the Government's needs. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted. For the reasons specified in paragraph 4 above, BIOPAC Systems is the only brand that can meet the Government's needs. This requirement is less than $25,000, and therefore will not be synopsized in the government point of entry per FAR Exception 5.202(a)(11). Any other facts supporting the justification. None. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made. As stated in paragraph 4 above, BIOPAC Systems is the only brand that can meet this requirement.
