The contract pertains to the non-competitive renewal of Broadcom/VMware software licenses for VMware Cloud Foundation and VMware Avi Load Balancer, justified under FAR 8.405-6(b)(1) as a brand-name sole source acquisition due to the software’s proprietary nature and its integral role in the Government’s existing virtual infrastructure. The item is deemed peculiar to one manufacturer because no alternative software is compatible with the current environment, and transitioning to another platform would necessitate a complete redeployment of the entire virtual infrastructure, resulting in prohibitive costs, significant operational downtime, extensive labor and training requirements, and irreversible disruption to mission-critical systems. The acquisition spans five years, beginning with a base period from February 1, 2026, through August 5, 2026, followed by four option years extending through August 5, 2030, with identical quantities of 2,136 VMware Cloud Foundation licenses and 16 Avi Load Balancers required annually for each period. The place of performance is designated as Virginia, with the contracting office located at Edwards Air Force Base, California. No pricing data is disclosed in the documentation, and the total contract value remains unspecified, though the procurement is considered a best value determination under FAR 8.404(d) and the price is affirmatively determined to be fair and reasonable under FAR 15.404-1(b). The contract is structured as a firm fixed price order under the GSA Multiple Award Schedule, with no formal evaluation factors, weights, or scoring criteria documented, and no inspection, acceptance, packaging, or delivery specifications beyond the brand-name justification. Contract administration responsibilities fall to the contracting officer, with no designated COR or COTR appointed, and no representations, certifications, or socioeconomic data are provided for the offeror. Legal review and internal certifications have been completed to substantiate the limited competition rationale, and the requirement includes three optional contract years that are pre-negotiated and tied directly to the core license quantities, ensuring continuity of operations without the burden of reprocurement.

General Info

FAR 8.405-6 requires an ordering activity to justify its actions when restricting consideration of schedule
contractors to fewer than required in FAR 8.405-1.

FAR 8.405-6(b)(1), “The item is peculiar to one manufacturer. A brand name item, whether available on one or more schedule contracts, is an item peculiar to one manufacturer.”

This software is the entirety of the virtual infrastructure that is currently operating on all of our networks. To overcome the restricted consideration, the agency would be required to completely redeploy the entire virtual infrastructure for all of our networks. There could potentially be all kinds of issues with trying to deploy different applications for the virtual infrastructure.  No other software is compatible with the current infrastructure and there would be a significant duplication of cost/labor/training/possible downtime that would be associated with switching to another virtual infrastructure product which would not be recovered through competition.
