Browns Valley Irrigation District Multiyear Temporary Water Transfers EIR

The Browns Valley Irrigation District is seeking regulatory approval to expand the annual window for releasing conserved water from July 1–October 31 to include April 1–June 30, enabling earlier delivery of up to 3,100 acre-feet per year to the Department of Water Resources for Delta outflows or to existing buyers using established CVP and SWP infrastructure. This modification, documented as an Addendum to the original Environmental Impact Report, does not involve new construction, changes to existing water rights, or increased annual volumes, and maintains all previous operational constraints including the use of historic diversion methods and delivery points. The expanded period supports enhanced water quality and fishery benefits in the Sacramento-San Joaquin River Delta during spring months while ensuring no new or more severe environmental impacts occur. All water transfers will continue to be managed through existing facilities, with deliveries restricted to the same buyers and within their historical diversion capacities. All activities are governed under the California Environmental Quality Act, requiring compliance with CEQA guidelines and submission of regulatory filings including Notices of Determination and environmental fee payments to the California Department of Fish and Wildlife. Financial transactions related to the project are limited to administrative fees for environmental reviews and do not constitute a formal procurement contract or pricing structure. There is no contract type, pricing, or federal acquisition regulation framework applicable, as the effort is purely an environmental compliance and regulatory amendment process. The District, as the lead agency, coordinates with the State Clearinghouse and Yuba County Clerk-Recorder for document filings, with no designated contracting officer, inspection criteria, or delivery terms beyond the operational parameters established by historical water use and CEQA-mandated environmental protections.
