The Naval Air Warfare Center, Aircraft Division, Lakehurst, New Jersey intends to solicit and award a Fixed Price contract on a sole source basis to SEAL DYNAMICS LLC (CAGE: 5N582)  2 ADAMS AVE HAUPPAUGE, NY 11788 for the purchase of a quantity of three (3) Engine Air Particle Protection Systems (EAPPS) Test Set (PN: 125710-1010) to support the domestic NAVAIR CH-53K Program.; an optional quantity of two (2) to support an FMS CH-53K Program; and an optional quantity of two (2) to support the domestic NAVAIR CH-53K Program.   


The Government intends to solicit and negotiate with only one source under the authority of FAR 6.302-1, "Only one responsible source and no other supplies or services will satisfy agency requirements" for this action. This piece of Support Equipment is only used on the CH-53K series of helicopters, no other aircraft in the U.S. inventory utilizes these items. The Government does not have data or drawing rights to permit full and open competition. This is further substantiated by the assignment of the "3H" for the Acquisition Method Code which identifies direct purchase from the manufacturer due to lack of sufficient data. Furthermore, Donaldson Company Inc. does not have any authorized distributors for this product and thus is the only source for procurement of this item.

The Government will consider all information received prior to the closing date of this notice.  A determination by the Government not to compete this procurement based upon responses to this notice is solely within the discretion of the Government.  The Government will not pay for any responses received.  There are no commitments by the Government to issue any solicitations, make an award or awards, or to be responsible for any monies expended by any interested parties before award of a contract for the efforts mentioned above.
