The Food and Drug Administration is seeking a new contract for cable TV subscriptions to serve the CFSAN buildings CPK1 and CPK2 in College Park, Maryland. The proposed agreement consists of a three month base period and a 12 month option period, with an estimated total value of 37,000 dollars. This acquisition is being conducted as a sole source procurement under FAR 13.106-1(b)(1)(i) because Comcast is the only reasonably available source capable of meeting the November 1, 2016, service deadline. Utilizing a different vendor would require the installation of new infrastructure and cable drops, and satellite alternatives would necessitate GSA approval, making competition infeasible. A Notice of Intent to Sole Source was posted in October 2016, but the only response received did not meet the government's requirements.

Justification and Approval for Other Than Full and Open Competition Cable TV Subscription for FDA/CFSAN College Park, MD Buildings* 1 This document contains proprietary or procurement sensitive information related to the conduct of a federal agency procurement and shall not be disclosed to any person other than a person authorized by the contracting officer to receive such information. 1. Contract/Order No. Requisition number: 1175085 - c. Description of supplies or services: Cable TV Services - d. Estimated Dollar Value: $37,000 4. Statutory Authority: This acquisition is conducted under the authority of the FAR 13.106-1(b)(1)(i), soliciting from a single source for purchases not exceeding the simplified acquisition threshold, only one source is reasonably available. 5. Contractor's Unique Qualifications to Provide the Services or Supplies and/or Why The Nature of the Acquisition Requires Use of the Authority Cited. Previous contracts for cable services have been provided by Comcast. Should this requirement be competed and awarded to a new vendor utilizing a different technology to distribute the signal, current infrastructure could not be utilized, and the vendor would need to install the required infrastructure to support their services in order to meet the level of performance and service currently being received. The new vendor may need to reinstall all of existing cable drops and set up for the initial installation. If the new vendor has to develop a new infrastructure and cable drops it should meet CFSAN starting service date of November 1, 2016. Satellite services can't be provided without infrastructure approval from the General Service Administration (GSA). Therefore, due to the November 1 deadline for service and additional GSA approval requirements, it is not feasible to seek competition for this requirement. 6. Description of Efforts Made to Ensure Offers Are Solicited from As Many Potential Sources As Practicable. FDA posted a Notice of Intent to Sole Source on October 11, 2016, which closed on October 24, 2016. Only one response was received. Contracting Officer Certification: I certify that this submission is accurate and contains complete data necessary to support the recommendations for approval. The contracting officer further certifies that an award of this contract action from this requirement will be made only if the price or cost to the Government is determined to be fair and reasonable. __________________________________________________ Contracting Officer Date Reviewed and Concur: __________________________________________________ Division Director Date
