The Auditor of Public Accounts for the Commonwealth of Virginia is soliciting unsealed bids for the procurement of 15 licenses of CommonLook PDF Software. This is a brand-name only requirement, meaning bids will only be accepted for the exact brand and model specified. The contract will be awarded to the lowest responsive and responsible bidder based on net prices, including unit prices and grand totals. All bids must be submitted through the eVA internet procurement portal. The selected contractor must comply with various Virginia state laws, including data privacy standards under section 2.2-2009 and prohibited technology restrictions under section 2.2-5514. Additionally, the contractor must certify that the software conforms to ICT accessibility standards and provide a State Corporation Commission identification number. Insurance requirements include Workers Compensation, 100,000 dollars in Employer Liability, and Commercial General Liability of 1 million dollars per occurrence and 2 million dollars in aggregate, with the Commonwealth of Virginia named as an additional insured. The Commonwealth reserves the right to inspect and test the software within 30 days of receipt to ensure it conforms to specifications, with the right to reject the product for a full refund if it fails to perform. Invoicing must occur within 30 days after delivery, and payment terms shorter than 30 days will be adjusted to 30 days after the invoice or delivery date, whichever is later. The contractor must also warrant that the software contains no shutdown devices, such as viruses or worms, capable of altering data or halting operations.
