An Advanced Contract Award Notice (ACAN) indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other supplier to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier.
1. Definition of the requirement
The Canada Border Services Agency (CBSA) in the Headquarters (HQ) region has a requirement for the supply of five (5) user accounts to access LexisNexis modules: Nexis 1519441 & 1519442, News 1010610, All Company & Financial 1011804, Legal News 1011823., for one (1) year with two (2) option years, including maintenance and support, in order to conduct open-source research using unclassified information from recognized and reputable sources to provide relevant accurate and reliable information as part of the intelligence process. This license must allow for ownership change for users during the term of the contract.
2. Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements)
Any interested supplier must demonstrate by way of a statement of capabilities that it meets the following requirements:
(a) Information must include content/data pertaining to media from around the world relating to international events, national security, contraband, organized crime and irregular migration.
(b) Provide access to a comprehensive, site with advanced search options that contains media sourced from around the globe.
(c) Content should include the highest possible amount of news sites including premium sources for local, national and international media
(d) A comprehensive level of archived information dating back in excess of several years.
2.1 Substantiation of experience for Statement of Capabilities
Suppliers must provide substantiation for each experience requirement above (article a. through d). Suppliers must provide a narrative (or a reference to a narrative) providing sufficient description, service description, documentation and/or other information as necessary to substantiate, to the sole satisfaction of the Government evaluators, of how each experience criteria is met. Suppliers are cautioned that a simple restatement that the Supplier complies with the requirement will not be considered substantiation.
3. Applicability of the trade agreement(s) to the procurement
This procurement is not subject to any of the trade agreements.
4. Justification for the Pre-Identified Supplier
To Canada’s knowledge, LexisNexis is the only supplier who can meet the proposed essential requirements.
5. Government Contracts Regulations Exception(s)
Indicate all relevant exceptions under the Government Contracts Regulations (GCRs).
The following exception(s) to the Government Contracts Regulations is (are) invoked for this procurement under subsection 6(d) - only one person is capable of performing the work.
6. Period of the proposed contract or delivery date
The proposed contract is for a period of one (1) year with two (2) option year periods.
o Estimated start date: December 18, 2024
o Estimated end date: December 17, 2027
7. Cost estimate of the proposed contract
The estimated value of the proposed contract is $36,469.62 (CAD). $10,758.00 for the first year and $21,516.00 for the remaining two option years. Applicable taxes are extra

9. Suppliers' right to submit a statement of capabilities
Suppliers who consider themselves fully qualified and available to provide the goods, services or construction services described in the ACAN may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
