Based on information provided below, request the Contracting Officer determine that only one source is reasonably available to provide the supplies and/or services described herein. 1. Description of supplies and/or services: For its Virtual School, DoDEA requires one source for images, video clips, audio tracks, and Flash media to enhance its content-driven coursework. These digital media must be of professional quality and comply with copyright laws. 2. Proposed contractor: iStockphoto LP, 1240 20th Ave SE, Suite 200, Calgary, Alberta T2G 1MB Canada 3. Reason the proposed contractor is the only source reasonably available: iStockphoto is a division of Getty Images but functions independently with the benefits of having access to all Getty Images collections. Many popular photographers exclusively sell their royalty-free images only on iStockphoto. Because of that iStockphoto has more than 60% exclusive content of photography and video from popular contributors. Market research has determined that no other vendor has the capability to provide all three media (images, audio and video) and no other vendor has a collection equal to iStock's portfolio. DoDEA Virtual School web developers need access to iStockphoto's large collection of media because no other vendor has enough of all three media content to support Virtual School's constantly updated online coursework. 4. Will these same supplies and/or services be needed again? Yes. During the past six months, extensive market research has been conducted to determine the availability of digital media content providers that can meet DoDEA's requirements for royalty-free images, audio and video. This research has included internet research and contact with potential vendors. DoDEA instructional designers continually monitor new developments and access to digital media for the DoDEA Virtual School. As requirements change and new alternatives for meeting them enter the marketplace, all interested vendors will be given the opportunity to compete. 5. Price reasonableness: iStockphoto's price list is published online making their prices fair and reasonable based published market pricing (FAR 13.106-3(a)(2)(iii).
