The Department of Housing and Urban Development (HUD) plans to award a sole-source contract to Lockheed Martin for E-Discovery Support Services and System, ensuring continuity of critical litigation support. This action is justified under the FAR 6.302-2(a)(2) clause due to unusual and compelling urgency, with no other suppliers capable of meeting HUD’s specific needs for uninterrupted E-Discovery Management System (EDMS) support. The existing contract with Lockheed Martin, which provides compliance with preservation and production requirements under the Federal Rules of Civil Procedure (FRCP) for electronically stored information and other records, is ending on September 29, 2016. Given the risk of gaps in service that could result in costly legal sanctions, HUD must maintain this capability uninterrupted while transitioning to a new, yet-to-be-awarded HEAT contract. Lockheed Martin is uniquely positioned to deliver these services without interruption, as confirmed by market research. The department’s urgency stems from critical court-mandated deadlines and the uncertainty surrounding the award and implementation of the HEAT contract. The sole-source contract is therefore set for an anticipated award date of September 29, 2016. The contract falls under NAICS code 541990, with Marco Moses as the point of contact. This procurement approach ensures HUD’s continuous ability to meet its E-Discovery obligations, safeguarding both legal compliance and the department’s interests in ongoing litigation processes.

Full Description

The Department of Housing and Urban Development (HUD) intends to award a contract on a sole-source bases, in accordance with FAR Part 15, to Lockheed Martine, located at 2275 Research Blvd, Rockville, MD 20850. The sole source justification is issued under the authority of 6.302-2 (a)(2) "Unusual and compelling urgency and No Other Supplies or Services Will Satisfy Agency Requirements" as implemented by FAR 6.302-2. E-Discovery Management System (EDMS) allows the Department to comply with the preservation and production requirements for ESI, paper records, and other evidence imposed by the FRCP. The current contract with Lockheed Martin providing E-Discovery Management System and Program support is in its final option year and will expire on September 29, 2016. These services will be migrated to the HEAT contract that is currently in active procurement with a planned, but not actual award date. Given critical court discovery deadlines, HUD intends to award a sole-source contract to ensure that there is no lapse of E-Discovery support for HUD, and the Secretary is not exposed to the risk of costly sanctions. There is no guarantee that the HEAT contract will be awarded and HUD Network support will be sufficiently transitioned to ensure its ability to seamlessly meet the Department's E-Discovery needs by September 30, 2016. E-Discovery continued support, with no lapse in service, is imperative to protect the Department's interest in effective and successful litigation and to avoid the high costs of noncompliance. Market research shows that Lockheed Martine is the only vendor with the capacity to provide all of the above requirements to support HUD's program needs with no lapse in services or lengthy transition. The anticipated award date is September 29, 2016.
