Full Description

The Boulder County Community Planning and Permitting Department is soliciting proposals from qualified engineering firms to evaluate the methodologies, accuracy, and conclusions of several traffic studies related to past and ongoing operations at the CEMEX Longmont Lyons Cement Plant.
On April 10, 2024, the Director of the Boulder County Community Planning and Permitting Department (“CPP”) issued a Notice of Termination of Nonconforming Status (the “Determination”), finding that the right to continue the nonconforming cement plant use at 5134 Ute Highway terminated as a result of a substantial increase in truck traffic and associated impacts following the closure of the Dowe Flats Quarry in September of 2022. As part of the Determination, the Director of CPP relied on traffic data from the CEMEX Lyons Access Traffic Study, which was prepared for CEMEX Construction Materials South LLC (“CEMEX”) by Stantec Consulting Services Inc. (“Stantec”) on August 28, 2023.
On November 7, 2024, CEMEX submitted a Supplemental Response to Notice of Termination of Nonconforming Status (“Supplemental Response”) stating that the Determination was made in error. In support of its Supplemental Response, CEMEX provided additional traffic information from Stantec titled the “CEMEX Access Analysis – Supplement Memo” and an additional traffic study from Landis Evans + Partners, titled the “CEMEX Lyons Plant Traffic Study.”
On December 20, 2024, CPP also received a letter from Save Our Saint Vrain Valley, Inc. and Good Neighbors of Lyons related to the Determination, which included a 1993 traffic study prepared by Felsburg Holt & Ullevig and titled the “Traffic Impact Analysis, Dowe Flats Project.”
The CPP Director is now reviewing this additional information to determine whether to uphold the Determination, revise the Determination, or rescind the Determination. To assist in this process, CPP seeks an engineering firm with experience analyzing traffic studies with differing methodologies and conflicting results, a strong understanding of the cement manufacturing process, and the ability to determine the accuracy of conclusions made in the traffic studies outlined above.
