This is a notice of intent to award a sole source contract. EPA Region 1 New England located at 5 Post Office Sq, Boston, MA 02109 intends to negotiate a sole source contract with TSI Incorporated for 9 each of the following: 8530 Dusttrak II Aerosol Monitors, 8535 Dusttrak Environmental Enclosures, 6600 mAH Li-Ion Batteries and Dusttrak II ESP Internal Battery Systems. The Government intends to solicit, negotiate and award to only one contractor using other than full and open competition procedures pursuant to the authority of FAR 13.106-1(b)(1). In accordance with FAR 13.106-1(b)(1)(ii) and FAR 11.105 an item peculiar to one manufacturer, e.g. a brand name, shall not be used unless the particular brand name, product, or feature is essential to the Government's requirements and market research indicates other companies similar products or products lacking the particular feature, do not meet, or can not meet the agency's needs. The use of a brand name for the acquisition of these aerosol monitors is necessary because no other known vendor provides a monitor that comes with a weatherproof enclosure which ensures accurate and precise measurements outdoors or in harsh industrial environments. TSI Incorporated does not distribute these products for resale. This notice of intent is not a request for competitive proposals, however all responses received by August 15, 2012 will be considered by the Government. The Government will not be responsible for any cost incurred for preparing a response to this notice. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement.
