(FAR Part 12.102(a) Restricting competition
In accordance with FAR Part 12.102(a) Restricting competition, the United States Fish and Wildlife Service (USFWS), on behalf of the FWS Klamath Falls Fish and Wildlife Refuge intends to issue a sole source award to the following contractor:
Bend Genetics LLC has extensive experience managing analysis for the Cyanotoxin suite (ELISA) and Cyanobacteria qualitative taxa identification system for agency clients and thus has the exact skills needed for this project. Bend Genetics has generated the Upper Klamath Lake cyanotoxin and taxa dataset since 2019, including under two prior NFWF sole source contracts for similar work, transitioning laboratories risks introducing inconsistency into the inherently subjective process of taxa identification, compromising the comparability of a decade-plus monitoring record used to inform ESA-listed sucker recovery and water quality management. This is not a solicitation for competitive proposal. No solicitation document is available. All responsible sources that have determined that they can provide the same products may submit product information and a capabilities statement that speaks to the products the US Fish and Wildlife Services are seeking in this proposed acquisition. All responses are due by Aug 10, 2026, 5 PM ET and can be sent to Kathy Coltran at kathryn_coltran@ios.doi.gov. A determination by the Government not to compete this proposed contract base upon responses to this notice is solely within the discretion of the Government. The estimated award date is 10 August 2026.
