The U.S. Department of Energy's Oak Ridge Operations intends to award a sole-source purchase order to Toxco, Inc. for the removal, inventory assessment, transport, and disposal of radiologically encumbered surplus materials at the ED-1 Site in Oak Ridge, Tennessee. Toxco, the current contractor with established expertise, will oversee inventory management, document materials received, coordinate pick-ups with DOE contractors, and ensure materials are surveyed for radiation and properly weighed. Materials deemed reusable will be segregated, while about 640,000 pounds of stored material will be dispositioned, with approximately 307,000 pounds evaluated for potential reuse. Material posing residual radioactivity above DOE authorized release criteria must be segregated and controlled by the contractor. This sole-source procurement follows FAR regulation 6.302-1 due to Toxco's unique qualifications, including an approved Safety and Health Plan and DOE Radiation Protection Plan, and their prior experience managing the site materials. Interested firms seeking to challenge the sole-source basis were invited to submit capability statements by a specified deadline in April 2004, but the government retains discretion on whether to engage in competitive procurement. The procurement process utilizes simplified acquisition procedures under FAR Part 13 and emphasizes that DOE will not reimburse firms for costs related to submitting capability information.
