The U.S. Army Corps of Engineers, Albuquerque District, intends to award a sole-source, Firm-Fixed Price purchase order to Caracal Enterprises, LLC dba VenTek International for subscription services supporting eight automated fee machines used in USACE Lakes and Dams operations. Although the government owns the physical machines, VenTek International holds proprietary software rights essential for collecting, reporting, and transferring park user fees to the U.S. Treasury, making it the only entity capable of providing the required services. These machines rely on VenTek’s proprietary system for real-time statistics, passive monitoring, remote configuration, and cloud-based data transmission to USACE databases, ensuring continuous revenue collection. The government has invested heavily in training personnel and integrating this system into its operations, and discontinuing service would render the machines inoperable, disrupting critical mission functions. The acquisition is justified under FAR 12.102(a) due to the absence of viable alternatives and the need for product continuity following prior purchases in 2021 and 2024. This notice is not a formal solicitation but provides an opportunity for other responsible sources to demonstrate competitive capability by submitting a proposal before the deadline of July 22, 2026, at 2:00 PM Mountain Daylight Time. Any submissions must clearly prove that competition would benefit the government; otherwise, the agency will proceed with the noncompetitive award. Responses must be sent via email to Glenda D. Kohlieber, and telephone responses are not accepted. Late or incomplete submissions will be disregarded. To qualify for award, firms must be actively registered in SAM, free of exclusions, and fully compliant with FAR and DFARS requirements. The government will not reimburse any costs incurred in responding, and a copy of the noncompetitive solicitation will be available upon request after the notice date.
