AI Contract Overview
The contract calls for the procurement of two BOLT, FLUID PASSAGE items under solicitation SPE7M4-24-T-0368, with a first article delivery requirement mandating submission of samples to the Non-Accountable Bay (Dear John Bay) Transportation Office at Tinker Air Force Base, Oklahoma, with “FIRST ARTICLES” clearly marked on the container. Delivery is due within 411 days after contract award, and all items must comply with the DLA Master List of Technical and Quality Requirements, which supersedes any conflicting specifications. The contract strictly prohibits the use of Class I ozone-depleting chemicals and requires approval for any substitute chemicals, overriding any prior specification mandates. Technical data associated with the item is subject to export controls under ITAR or EAR, restricting disclosure to foreign persons without prior authorization from the Department of State or Commerce; only contractors with approved US/Canada Joint Certification Program status, completed DLA training, and explicit DLA approval may access such data. Packaging and marking must adhere to MIL-STD-129 and ASTM D3951, with DLA’s RP001 governing palletization, while hazardous material labeling must meet 29 CFR 1910.1200. Cybersecurity compliance is mandatory under DFARS 252.204-7012, requiring implementation of NIST SP 800-171 safeguards for Controlled Unclassified Information and submission of a DoD assessment score to the Supplier Performance Risk System prior to award, with full government access to systems and facilities for verification. Contractors must also ensure subcontractors handling CUI comply with the same requirements. Invoicing must occur exclusively through WAWF, and payment routing relies on DoDAAC codes. The contract includes clauses for fixed-price inspection, default, changes, and safeguarding government information systems, with Alternate I of FAR 52.223-9 and Alternate I of FAR 52.222-36 in effect. All proposals must be submitted electronically via DIBBS by the deadline of October 20, 2023, and offerors must maintain current SAM registrations, including accurate representations of small business status and compliance with prohibitions on covered telecommunications equipment. The place of performance is identified as New Cumberland, Pennsylvania, and the contract does not specify pricing, contract value, or award basis, indicating a simplified acquisition route with potential LPTA evaluation methodology.
