Hydraulic Supply Kit K400B-XL

This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Parts 12 and 13, as supplemented with additional information included in this notice. This announcement constitutes that only solicitation quotes/proposals are being requested and a written solicitation will not be issued. The USAF can meet its minimum needs only by procuring a hydraulic supply kit for a K400B-XL test stand produced by Avtron Aerospace. Only Avtron aerospace has the capability of producing these replacement parts due to the fact that they own rights to the replacement parts and the original test stand. Given the proprietary nature of these replacement parts, reverse engineering is not an option in that it may result in patent infringement issues as well as produce excessive costs. AUTHORITY: 10 U.S.C. 2304(c)(1), JUSTIFICATION: SUPPLIES REQUIRED ARE FROM ONLY ONE OR A LIMITED NUMBER OF RESPONSIBLE SOURCE(S) AND NO OTHER TYPE OF SUPPLIES WILL SATISFY AGENCY REQUIREMENTS. The proposed contract action is for supplies and services for which the government intends to solicit and negotiate with only one, or a limited number of sources under the authority of FAR Part 13. All responsible sources may submit a capability statement, proposal, or quotation, which shall be considered by the agency. This notice of intent is not a request for competitive proposals. However, all proposals received prior to the closing date on the solicitation will be considered by the government. A determination by the government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. Specification, plans, or drawing relating to the procurement described are incomplete or not available and cannot be furnished by the government. The government does not own the data or rights to the data needed to purchase the item from additional sources. The Government intends to issue a sole source contract. The contractor (Avtron) will provide (1) Hydraulic Supply Kit for a K400B-XL Generator Test Stand, Contracting by Negotiation. The solicitation will posted at http://www.fedbizopps.gov/ under solicitation number FA8224-11-T-0014 on or around December 16, 2010. This requirement is considered sole source due to the fact the test stands are proprietary to Avtron and all parts required for maintenance are also proprietary to Avtron. This notice is not a request for competitive proposals and all other interested contractors shall submit a capabilities document which states their abilities on fulfilling this requirement. Responses should be submitted by 11:30 am MST on December 21.
