Intent to award sole source contract

The Expeditionary Contracting Command-Afghanistan (ECC-A) Reachback office located at Camp As Sayliyah (CAS) Qatar intends to award a firm fixed price, sole source contract to Atlantic Diving Supply Inc.(ADS Inc.) for the production of fabric printed with a proprietary camouflage pattern necessary for the assembly of One Hundred Ninety Five Thousand Afghanistan National Army (ANA) uniforms using the Spec4ce Forest uniform pattern that is owned and trademarked by Hyper Stealth Biotechnology Corp (HBC) whom has a worldwide exclusive licensing agreement with ADS Inc. as the only distributor. The North American Industry Classification System (NAICS) code for this acquisition is 313210 - Broadwoven Fabric Mills. The NAICS Code was identified through a review of the U.S. Census Bureau's website at http://www.census.gov/cgi/bin/sssd/naics/naicsrch?code=313210. NAICS 313210 was considered and selected as this industry comprises establishments primarily engaged in weaving broadwoven fabrics and felts. The size standard is 1,000 employees. THIS IS NOT A REQUEST FOR COMPETITIVE QUOTES. This is a notice of intent to award a sole source contract under statutory authority 41 U.S.C. 1901 & 1903 permit the use, in certain circumstances, of simplified acquisition techniques above the simplified acquisition threshold in support of contingency operations. Simplified acquisition procedures are described at FAR Part 13, and allow for sole-source awards. The requirements of FAR Part 6, which identify the sole- and limited-source exceptions to the Competition in Contracting Act, 10 U.S.C. - 2304, do not apply to simplified acquisitions, 10 U.S.C. - 2304(g); in turn, FAR - 13.501 permits use of sole- and limited-source awards when simplified techniques are used above the threshold as permitted by 41 U.S.C. 1901 & 1903. Although a Justification & Approval must be prepared in the format required by FAR - 6.303-2 (and AFARS 5153.303-5), the authority is not one of the statutory exceptions to CICA enumerated in FAR - 6.302; instead, the statutory authority the more broad exception described in 41 U.S.C. 1901 & 1903. All responsible sources may submit a capability statement, which shall be considered by the agency before the intended award date. Interested sources who submit data are responsible for appropriately marking information if it is proprietary in nature. The Government shall not reimburse interested sources for any information provided. No requests for capability briefings will be honored as a result of this notice and any information provided will not be used as part of any subsequent solicitation requirement. This item maybe awarded without further notice. No telephonic inquires will be honored. The anticipated award date is September 29, 2016.
