NOTICE OF INTENT TO AWARD A SOLE SOURCE CONTRACT- National Guard Bureau, United States Property and Fiscal Office for South Carolina, intends to solicit and award a sole source contract to Motorola Solutions, Inc. 500 W. Monroe Street, Ste 4400, Chicago, IL 60661-3781 to provide and install one new Scout EX communication console system and tie-in, service, and maintain ancillary Command Post dispatch system components. This communication console system is utilized extensively by the Department of Defense, the U.S. Air Force, the National Guard Bureau and the South Carolina South Carolina Air National Guard; for which the National Guard currently has DoD Enterprise License Agreement (ELA). This synopsis is for notification purposes only and does not constitute a solicitation for bids, quotes, or proposals. A firm fixed price contract is contemplated for the result award. The Government does not intend to pay for any information provided under this notice. A determination by the Government not to compete this proposed contract based on this notice is solely within the discretion of the Government. The planned Motorola contractor possesses the manpower and resources, and owns the required proprietary data rights to cross over the new console while continuing the performance of the existing auxiliary components without additional phase-in or mission downtime. Award to any other source would result in duplication of cost to the government that is not expected to be recovered through competition and will result in unacceptable delays in fulfilling the agency's requirement. This estimate includes the cost to replace proprietary Motorola equipment. Schedule delays would be expected to award a new contract due to the time required to demonstrate replacement equipment compatibility with existing systems. This additional time would result in a gap in emergency service response capabilities. Therefore, when all factors are considered, it is in the Government's best interests to contract with Motorola Solutions, Inc. as the only responsible source that will satisfy agency requirements. This sole source requirement meets the conditions of FAR 6.302-1, only one responsible source has been identified as reasonably available to provide the supplies that will satisfy the agency requirements. Motorola Solutions is the sole provider and direct affiliate that can provide the Scout Console. No other firms have been identified. The Contracting Officer has determined that the anticipated cost to the Government will be fair and reasonable. Due to the commercial nature of the console to be acquired, the price reasonableness determination will be based on prices paid for the same or similar commercial items under comparable terms and conditions by both Government and commercial customers, including pricing information contained in published price lists and previous contracts for the same or similar items. If the Contracting Officer cannot obtain adequate information from sources other than Motorola Solutions, Inc., the offeror will be required to submit other than certified cost or pricing data including, at a minimum, appropriate information on the prices at which the same or similar items have previously been sold, adequate for determining price reasonableness in accordance with FAR 15.403-3(a)(1)(iv). If comparable sales data is unavailable, other relevant information regarding the basis for price, including information on labor costs, material costs and overhead rates may be requested from Motorola Solutions, Inc. in accordance with FAR 15.403-1(c)(3)(ii)(C).
