The contract involves the procurement of a specific brand-name item, the D260 7.6L International Engine, which is required as a replacement engine for vehicles currently in service. The justification for this brand-name purchase is based on the need to maintain compatibility with the original equipment installed by the chassis manufacturer, as engines with differing specifications would not fit or function properly within the vehicle's engine compartment. The Government has determined that this exact brand is essential to meet operational requirements, and no alternative products can fulfill these needs without compromising design and functionality. This procurement follows regulations allowing a brand-name specification when only one product meets the agency’s needs, specifically under FAR 6.302-1(c) and 10 USC 2304(c)(1). The acquisition is handled under Simplified Acquisition Procedures, with the dollar amount expected to remain below the Simplified Acquisition Threshold, thus not requiring a formal Justification and Approval document. The contract is set aside entirely for small businesses under FAR 19.5 and is managed by the Department of Defense office based at Malmstrom Air Force Base in Montana, with the place of performance in Great Falls, Montana. The contracting officer, Linda K. Redding, has signed the determination confirming that this is a sound business decision in the Government’s best interest.

DETERMINATION AND FINDINGS SUBJECT: Brand Name Procurement D260 7.6L International Engine) FINDINGS 1. In accordance with (IAW) FAR 6.302-1(c), the use of such descriptions in the acquisition is essential to the Government's requirements, thereby precluding consideration of a product manufactured by another company. Also, IAW IG5306 Air Force Contracting Guidelines, J&A is not required for purchases under procedures in FAR Part 13, Simplified Acquisition Procedures. Dollar amount on requirement is not expected to exceed the SAT. 2. IAW 10 USC 2304(c)(1), the subject requirement of the agency is available as only one brand name and no other type of property or services will satisfy the needs of the agency. Written justification from the customer was received stating the reasons and characteristics of the desired product, International Engine D260 7.6L. 3. The requested brand name item is a replacement engine for a vehicle already in service. The engine is to replace original equipment installed by the manufacturer of the chassis.
