AI Contract Overview
The Export-Import Bank of the United States is seeking to establish multiple Blanket Purchase Agreements (BPAs) with qualified recovery firms to provide worldwide loan recovery services for paid claims under its credit guarantee and insurance programs. Contractors must deliver comprehensive collection, legal, and asset recovery services, including borrower negotiations, asset searches, extrajudicial collections, litigation preparation, and enforcement actions across international jurisdictions. The work is performance-based, requiring detailed deliverables such as a Due Diligence/Recovery Plan within 60 days of contract award, quarterly Extrajudicial Collection Status Reports, a Litigation Request Form prior to any legal action, and semiannual litigation status updates—all submitted electronically in English. The contract operates as an IDIQ-style BPA with a maximum potential duration of five years, extendable by six months, and no guaranteed minimum order value. Each task order under the BPA will be priced on a firm-fixed-price basis, composed of a fixed due diligence fee per case and a contingency fee based on a percentage of successfully recovered assets, with payments triggered only upon successful outcomes. Offerors must demonstrate proven international capabilities, including established in-country legal and operational capacity in each country where services are proposed, supported by at least two completed or ongoing U.S. federal government projects per jurisdiction as a prime contractor. Technical proposals must be submitted separately from pricing documents, with no pricing information allowed in the technical submission to ensure fair evaluation. Evaluation is based on a best-value tradeoff, prioritizing the technical and management approach—particularly geographic coverage, cross-border experience, and alignment with foreign legal systems—over past performance, which in turn outweighs price. The government will not engage in discussions prior to award, and vendors must submit their best and final terms upfront. Only electronic PDF submissions via email to the designated contracting officer are accepted, with no FAX or hard copy submissions permitted. All contractors must be registered in SAM.gov, possess a Unique Entity ID, and comply with strict reporting protocols, including prior written authorization for litigation or extraordinary expenses. Performance may occur worldwide, including Washington D.C., with no physical goods delivery and no applicable packaging, marking, or preservation standards, as the entire scope is digital and service-driven.
