AI Contract Overview

The contract involves the procurement of four units of a fluid filter identified by NSN 7H-4330-011451037, with the technical data package version 002. Delivery terms are FOB origin, with the items to be issued to Pall AeroPower Corporation in New Port Richey, Florida. The Government intends to award this contract through negotiation with a single approved source due to the specialized nature of the part, which requires engineering source approval by the design control activity to ensure quality. The qualified source possesses unique design capabilities, manufacturing expertise, and retains critical technical data and rights that are not economically feasible for the Government to acquire or replicate through reverse engineering. Any alternate sources must undergo qualification in accordance with government-approved procedures before being considered eligible suppliers. This procurement is conducted under the authority of FAR 6.302-1, allowing a sole-source negotiation without competitive quotes, although the Government invites interested parties to express their interest or submit proposals within a specified timeframe for consideration. Responses will be used to determine whether to pursue competitive procurement, but the final decision not to compete lies solely with the Government. Furthermore, the Government has excluded the use of commercial item acquisition policies for this requirement but will consider commercial solutions if proposed within 15 days of the notice. Relevant military and federal specifications and related documents for compliance and qualification purposes are accessible through designated DoD distribution points. Award will depend on meeting stringent qualification requirements to maintain the integrity and performance standards of the required fluid filter component.
