Notice of Intent to Sole Source for Oxford Instruments America, Inc. Service Maintenance Agreement for the following microanalytical tools:
• Aztec/mics/x-stream2/SEMX-Act/Nordlys (S/N: SC38575/53481/NL03-1766-02)
• Aztec micsF+/x-stream2/X-Max50 (S/N: SO72398/72398)
In accordance with Federal Acquisition Regulation (FAR) Part 12, Acquisition of Commercial Products and Commercial Services, the Department of Energy (DOE), National Energy Technology Laboratory (NETL) intends to negotiate and award a purchase order on a sole source basis to Oxford Instruments America, Inc. NETL requires continuation of coverage for the service maintenance agreement of Microanalytical tools listed above. These Microanalytical tools contain unique specifications in which only the original equipment manufacturer (OEM) can maintain, service, and repair. The microanalysis tools (software) along with the associated hardware must be properly maintained to ensure high quality research results. The support plans will ensure continued safe, reliable, and satisfactory operation of the manufacturer’s instruments. Maintenance, service, repair, replacement parts and software must be obtained from the OEM. This is considered a sole source to Oxford Instruments America Inc. as to the best of the NETL’s knowledge, based on market research conducted, Oxford Instruments America Inc. is the only known source that can offer the required comprehensive Maintenance Agreement for NETL Pittsburgh. No known potential alternate sources exist which could satisfy NETL's requirements.
This notice of intent is not a request for quote/proposal. Any interested party that believes it can meet the NETL requirement described herein may identify themselves and must provide evidence of their capability to fulfill the requirement being requested by 5:00 PM ET on May 21, 2026. Responses must be submitted in writing to the Contract Specialist, Arturo Manantan, via email at arturo.manantan@netl.doe.gov no later than the time and date noted above. Telephone responses and requests will not be received.
A determination by the Government not to compete this requirement based on responses to this notice is solely within the discretion of the Government. Information received will be considered solely for determining whether to conduct a competitive procurement.
