The Department of Veterans Affairs, specifically the Cleveland VA Medical Center under VISN10, entered into a sole-source procurement agreement with Given Imaging, also identified as Covidien Sales LLC, for the repair and maintenance of a Barrx Flex RFA unit. This action, identified by Action ID 36C250-20-AP-3482 and solicitation number 36C25020C0171, was awarded on June 29, 2020, for a total amount of 38,000.01 dollars. The contract falls under NAICS Code 339113 and was processed using Simplified Acquisition Procedures for awards over the micro-purchase threshold but not exceeding the simplified acquisition threshold of 250,000 dollars. The justification for the single-source award is based on the requirement for original equipment manufacturer parts, tools, materials, and software to ensure the equipment meets specific capabilities and specifications. Because third-party vendors lack access to these proprietary components and the necessary OEM certified field service engineers, the government determined that only one responsible source could perform the required labor, management, and technical services. This determination was certified in accordance with FAR 13.106-1, noting that market research via the VIP database confirmed no other viable service-disabled veteran-owned or veteran-owned small business contractors were available.
