Subject:           PR #12461398 for Procurement of Maintenance and Repair Services for Leica Microsystems Medical Devices

Reference:       RFO 12.102(a) “Restricting Competition”

1.) The purpose of this memorandum is to document the Contracting Officer’s decision that only one source is reasonably available to satisfy this requirement.

2.) The following determination is based on the extensive training, knowledge and market research conducted by Walter Reed National Military Medical Center (WRNMMC) medical training personnel and the independent market research performed by the Contract Analyst and Contracting Officer. Leica Microsystems Inc is the only company capable of providing the required expertise, knowledge, and turn around time necessary to maintain the three Leica Cryostat devices at Walter Reed National Military Medical Center without voiding the warranty. Leica Microsystems does not have any authorized third-party maintenance providers and explicitly states that any third party intervention voids liability and warranty.

3.) Leica Microsystems, Inc. (CAGE Code 2F735), has been identified as the sole source awardee under the relevant NAICS code (811210) and is the sole provider of the required services.

4.) I hereby determine that only one source, Leica Microsystems Inc. is reasonably available to satisfy this requirement, and this procurement is in the best interest of the Government.

Solicitation # NARA-883103-26-Q-00020
The National Archives and Records Administration is soliciting quotations for a firm-fixed-price contract to provide bench tests, maintenance, repair, and calibration services for eight RTI video tape cleaner/evaluator machines. The primary objective is to restore these obsolete machines to factory specifications to ensure the safe cleaning and evaluation of archival video records. The contract structure includes a base year and four option years, with services performed either on-site at Archives II in College Park, Maryland, or off-site for complex repairs. The contractor is responsible for all shipping logistics and costs, and all maintenance must be completed within 30 business days of the coordinated start date. This is an unrestricted acquisition under NAICS 811210, utilizing a lowest price technically acceptable evaluation method. The total evaluated price will be based on the sum of all performance years plus half of the final option year ceiling price. Quotations must be submitted by September 21, 2026, and must include a completed schedule of prices, an information sheet with UEI and CAGE code, and proof of the ability to perform the specified services. Acceptance of the work is contingent upon the full functionality of the machines, which will be verified by NARA staff within seven business days of receiving the contractor's bench test report.

The Defense Health Agency, through the HCD-Southeast contracting activity, intends to award a firm-fixed-price, sole-source bridge contract to Sysmex America, Inc. as a logical follow-on to contract W91YTZ21F0228. This requirement is for the continued provision of four fully automated FDA-approved Complete Blood Count (CBC) analyzer systems, including the necessary instruments, reagents, service, and training. The contract supports the Department of Pathology at Winn Army Community Hospital, Hawks Medical Clinic, and Richmond Hill Medical Home, all located at Fort Stewart, Georgia. The period of performance is established from October 1, 2026, to September 30, 2027, utilizing a cost-per-reportable pricing arrangement. Key operational requirements include the provision of on-site technical support for installation and the performance of preventive maintenance at the contractor's expense. The systems must feature on-board barcode scanners capable of recognizing CHCS generated code 128 labels for positive patient identification. All reagents and equipment must be shipped according to manufacturer temperature specifications. Performance will be monitored via a Quality Assurance Surveillance Plan, with method validation adhering to Clinical Laboratory Standards Institute and College of American Pathologists standards. Administrative requirements mandate the use of the Wide Area Workflow system for electronic invoicing and strict adherence to HIPAA Privacy and Security regulations through a Business Associate Agreement. The contractor must also implement comprehensive administrative, technical, and physical safeguards for government data and follow DoD standards for the disposal of unclassified electronic media. While the acquisition is designated for Small Business, HUBZone, and SDVOSB concerns, a ten percent price evaluation preference is applied to non-HUBZone offers.
