AI Contract Overview
The contract involves the procurement of 10 units of LENS, LIGHT with NSN 6210-01-384-2292 under solicitation SPE8E7-26-T-3356, issued by the Defense Logistics Agency’s DDSP New Cumberland Facility. Delivery is required within 160 days after award, with FOB Origin terms placing responsibility for shipping costs and risk of loss on the contractor until the goods leave their shipping point. The delivery destination is the DLA Distribution New Cumberland Facility in New Cumberland, Pennsylvania, where inspection and formal acceptance by the Government will occur. Packaging must comply with MIL-STD-2073-1E and DLA-specific requirements, including specified preservation methods, wrapping materials, and unit container standards, while labeling and barcoding must follow MIL-STD-129, with additional adherence to OSHA’s Hazard Communication Standard for any hazardous materials. The item is subject to export control under ITAR or EAR, restricting disclosure to foreign persons regardless of location, and only contractors with approved U.S./Canada Joint Certification Program status, completed DLA export training, and authorized access may handle the technical data, per DFARS 252.225-7048. The contract incorporates multiple FAR and DFARS clauses governing contractor obligations including cybersecurity compliance under FAR 52.240-93 and DFARS 252.204-7012 for safeguarding covered defense information and reporting cyber incidents, with explicit reference to CMMC Level 2 certification for third-party assessors. Contractors must verify employment eligibility, comply with anti-trafficking requirements, and adhere to sustainable procurement practices. Invoicing must be submitted electronically via WAWF using the appropriate form based on contract type, and payment processing relies on DoDAAC codes not fully detailed in the solicitation. Representations and certifications required include UEI and CAGE code submission, small business size status, and disclosures related to covered telecommunications equipment or joint ventures, though actual affirmations from offerors are absent. The solicitation does not include pricing data, evaluation factors, or a complete statement of work, implying a fixed-price structure is likely but not formally confirmed, and award will be based on compliance with technical, packaging, cybersecurity, and export control requirements rather than price competition. The contract imposes strict limitations on disclosure of technical data and mandates full adherence to federal regulations throughout the lifecycle of the product.
