1. Advance Contract Award Notice (ACAN)
An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier.
2. Definition of the requirement
The Department of National Defence has a requirement for provision of services such as: Program Management, Systems Responsibility, Establish and operate Regional Maintenance Centre (RMC) in Edmonton, Alberta, Technical Service Representatives (TSRs)/Field Service Representatives (FSRs) employed nationally and internationally, Technical Investigations and Engineering Support (TIES), Special Investigations and Technical Studies (SITS), Spare Parts Supply, Depot Level Inspection and Repair (DLIR), and Upgrade, Fleet Management, Integrated Product Team (IPT), Special Tools and Test Equipment (STTE) Maintenance and Calibration; for the long term sustainment support for Canadian Leopard 2 Family of Vehicles (FoV).
Work is to be performed at the Contractor's facilities, at the Contractor's selected Sub-Contractor's facilities, and/or by Contractor's working at Department of National Defense (DND) or other facilities specified by the Technical Authority (TA). Contractors must have the Intellectual property or have agreements in place for use of such Intellectual Property to accomplish the required work at no additional cost to Canada. The work will involve the following:
The scope of equipment covered under the Long-Term Support Contract (LTSC) is outlined below, at a high level, for overall systems responsibilities:
• Leopard 2 A4 Canada (CAN), Main Battle Tank (MBT) • Leopard 2 A4M CAN, MBT • Leopard 2 A6M CAN, MBT • Leopard 2 A6M C2 CAN, MBT • Leopard 2 Armoured Recovery Vehicle (ARV) CAN • Leopard 2 Armoured Engineering Vehicle (AEV) CAN • Leopard 2 Mine Clearing Roller System (MCRS) • Leopard 2 Track Width Mine Plow (TWMP) • Leopard 2 Dozer Blade • Add-on Armour and slat armour • Support equipment, Special Tools and Test Equipment (STTE) specific to the Canadian Leopard 2 FOV • Leopard 2 Trainers: • Turret Operator Trainer (TOT) • Turret Crew Procedural Trainer (TCPT) • Turret Maintenance Trainer (TMT) • Leopard 2 Turrets (@ 202 WD): • A4 CAN • A6 C2 CAN • Software specific to the Canadian Leopard 2 FoV and support elements • Any other equipment specific to the Canadian Leo 2 FoV not covered above
3. Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements)
Any interested supplier must demonstrate by way of a statement of capabilities that it meets the following requirements:
The Contractor must have minimum 10 years of experience with providing following services that are required to support the Leopard 2 tank: • Systems integration • Systems engineering management • Configuration management • Obsolescence management • Depot Level Inspection and Repair (DLIR) • Spare parts supply • Provide technical service representatives (TSRs)/ Field Service Representatives (FSRs)
Experience: In order to demonstrate experience for the specified duration, the Contractor must include a Project Description, including information related to the work performed, type of equipment along with reference from organization(s) that requested the services. Each description should confirm how the Contractor supported each area of the services requested.
Intellectual Property Rights: The Contractor must have the necessary access to the Technical Data required to perform the planned Scope of Work under the Contract. Confirmation of access to Intellectual Property for Leopard 2 FoV must include legal agreement with all subcontractors.
4. Applicability of the trade agreement(s) to the procurement
The intent is to invoke the National Security Exception contained in all of Canada’s trade agreements, current and future, including the Canadian Free Trade Agreement, Article 801, for all purposes with respect to the procurement conducted by Public Works and Government Services Canada Acquisitions Program, on behalf of the Department of National Defence.
5. Set-aside under the Procurement Strategy for Indigenous Business
This procurement is not subject to set-aside for Indigenous suppliers under the Procurement Strategy for Indigenous Business (PSIB).
6. Comprehensive Land Claims Agreement(s)
This procurement is not subject to the Comprehensive Land Claims Agreements (CLCAs).
7. Justification for the Pre-Identified Supplier
Krauss-Maffei Wegmann GmbH & Co. KG (KMW) is the Leopard 2 Fleet of Vehicles (FoVs) system integrator, who owns the system drawings for the Leopard 2 MBT and has the right to use and to modify these drawings. This means that no other party is entitled to use the Leopard 2 MBT system drawings neither for upgrade nor for Depot Level Inspection and Repair (DLIR).
8. Government Contracts Regulations Exception(s)
The following exception(s) to the Government Contracts Regulations is (are) invoked for this procurement under subsection 6(d) - only one person is capable of performing the work.
9. Ownership of Intellectual Property
Ownership of any Foreground Intellectual Property arising out of the proposed contract will vest in the Contractor.
10. Period of the proposed contract or delivery date
The proposed contract is for a period of up to twelve (12) years, from contract award to 2035, including option years.

The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
13. Closing date for a submission of a statement of capabilities
The closing date and time for accepting statements of capabilities is 26 Aug 2022.

You are hereby notified that the government intends to negotiate with one firm only as identified above. Should you have any questions concerning this requirement, contact the contracting officer identified above.
An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process.
Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page.
The Crown retains the right to negotiate with suppliers on any procurement.
Documents may be submitted in either official language of Canada.
