Solicitation SPE7MX24RX001, issued by DLA Land and Maritime, seeks to establish a Firm Fixed Price Indefinite Quantity Contract for cartridge magazines. The contract is expected to span approximately five years, consisting of a three-year base period and two one-year option periods. Classified under NAICS code 332994 for Small Arms, Ordnance, and Ordnance Accessories Manufacturing, the procurement is being conducted as unrestricted with other than full and open competition because the government lacks complete technical data and the items are available from only one or a limited number of responsible sources. Due to the AMSC Z coding, the items must be acquired directly from the manufacturer. These components are categorized as commercial, nondevelopmental, or off-the-shelf items supporting various weapon systems, and no separate specifications or drawings are provided. While price is a significant factor, the final award decision will be based on a combination of price, delivery, and past performance. The acquisition may also be subject to the Trade Agreements Act of 1979.

Simplified Procedures for Certain Commercial Items under FAR 13.5 are Applicable. Solicitation SPE7MX24RX001 will be used to establish an Indefinite Quantity Contract (IQC), Firm Fixed Price (FFP) approximately five years in length for one, three-year base period and two, one-year option periods. The Contracting Officer (KO) has determined this item will be solicited unrestricted with other than full and open competition under the authority of 10 U.S.C. 3204(a)(1) and implemented by FAR 6.301. This NSN has an AMC/AMSC of 3/Z and a North American Industry Classification System (NAICS) code of 332994 Small Arms, Ordnance, and Ordnance Accessories Manufacturing (small business size 1000). This solicitation is being issued under the authority of 10 U.S.C. 3204(a)(1) and FAR 6.301 and contemplates the award of a contract for items of supply that are available from only one or a limited number of responsible sources. The item on this solicitation is coded as AMSC Z, which means this must be acquired directly from the manufacturer, whether or not the prime contractor is the actual manufacturer, and this part is commercial/nondevelopmental/off-the-shelf item. Commercial item descriptions, commercial vendor catalog or price lists or commercial manuals assigned a technical manual number apply. If one source is available, AMCs 2, 4 or 5 are valid. This item supports various weapon systems. Specifications, plans, or drawings are not available. This proposed procurement includes one Federal Supply Class: 1005. This acquisition is for supplies for which the Government does not possess complete, unrestrictive technical data; therefore, the Government intends to solicit and contract unrestricted with other than full and open competition under the authority of 10 U.S.C. 3204(a)(1). While price may be a significant factor in the evaluation of offers, the final award decision will be based upon a combination of price, delivery, past performance, and other factors as described in the solicitation. All offers/responses will be due as listed on the closing date and time specified on page 1 of the Standard Form 1449 (Solicitation for Commercial Items). All responsible sources may submit an offer/proposal, which shall be considered. One or more of the items under this acquisition may be subject to an Agreement on Government Procurement approved and implemented in the US by the Trade Agreements Act of 1979.
