Micro Rain Radar

This is a Notice of Proposed Contract Action under the FAR Part 12 Acquisition of Commercial Items and FAR Part 13 Simplified Acquisition Procedures. This notice is for information only; a solicitation will not be issued. THIS IS NOT A REQUEST FOR QUOTATION. No contract will be awarded on the basis of offers received in response to this notice. The associated North American Industry Classification System (NAICS) code is 334519 with a small business size standard of 500 employees. This effort is to purchase a Metek (original equipment manufacturer, Fritz-Stra'mann-Str. 4. 25337 Elmshorn Germany) micro-rain radar (MRR) Pro system to support in-house propagation research. The MRR is a continuous wave frequency modulated 24.23 GHz, low power (50 mW) radar that measures range resolved Doppler spectra and provides higher level products of rain characteristics including drop size distribution (DSD), intensity, and liquid water content. To fulfill the requirement the Government intends to negotiate a sole source contract with: ATS Services, Ltd 35 Auriga Drive, Unit 213 Ottawa ON K2E 8B7 +1 (555) 000-0000 POC: Larry Malenfant Market research to date has determined that no other source can meet the technical requirements offered by the MRR. Furthermore, ATS is the sole distributor in the arrangement between original equipment manufacturer, Metek, and product representative. ATS is the only authorized North American distributer and agent for Metek. In the event that the MRR were sourced through a party other than ATS, Metek would deny and not honor any requests for warranty service or claim, or respond to calls for technical support. This is a notice of proposed contract action and not a request for competitive proposals; however, all responsible sources may submit a capability statement or proposal, which shall be considered by the agency. Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government in future procurements. Responses received will be evaluated; however a determination by the Government not to compete the proposed procurement based upon responses to this notice is solely within the discretion of the Government. The Government anticipates an award date on or before 30 SEP 2018. A Sole Source Justification will be attached to the subsequent Notice of Award in accordance with applicable regulation.
