The Naval Surface Warfare Center, Indian Head Division, has awarded a sole-source modification to Basic Ordering Agreement N00174-23-G-0001, increasing the contract ceiling to 91,100,000 dollars. This agreement with BAE Systems, based in Minneapolis, Minnesota, provides critical support for the MK 38 MOD 3 Machine Gun Systems. The scope of work encompasses engineering services, Linux operating system upgrades, Mod2 to Mod3 conversion kits and associated hardware, spares, and open, inspect, and repair efforts. BAE Systems was selected as the sole provider due to their role as the supplier and their exclusive teaming agreement with the original manufacturer, Rafael Advanced Defense Systems, Ltd. The justification for this non-competitive action, cited under 10 U.S.C. 3204(a)(1), is based on the fact that BAE Systems possesses the necessary facilities for assembly and overhaul, and there is no Government-owned Technical Data Package available to facilitate competition.
